The tender shall have to be dropped in tender box kept in CEDMAP Head office, Bhopal, duly filled, sealed and signed at the mentioned address. All the bidders should also submitted demand draft of Rs. 30000/- (Rupees thirty thousand only) in favor of “CEDMAP”, payable at Bhopal, as the non interest bearing money deposit in separate sealed cover super –scribed “EMD cover”. The offers should be submitted in sealed cover super- scribed with EMD (Technical Bid). Only successful tenderer/ technically qualified tenderer shall be called for further process and services of Simhasth 2016 . No offer will be accepted without valid Earnest money deposit, unless exempted by CEDMAP Bhopal. If on opening tender, it is revealed that EMD amount is inadequate/ any other discrepancy is noticed, the tender shall be rejected and returned to the tenderer. All the rejected/ non qualified tenderers having EMD shall be refunded without interest.

IMPORTANT INSTRUCTIONS TO THE BIDDERS Sealed tenders are invited by Executive Director; CEDMAP Bhopal from tenderer parties should authorized service partner of any renowned company like Acer, Toshiba, DELL, HCL or equivalent company of respective items for supply of computer/laptop/Printers/etc. Having minimum 5 years experience and last continuous three years turnover minimum 50 lacs are the mandate for technical evaluation and tenderer should have the channel partner/partnership deed for Ujjain place or nearer place Indore (If their own office not available in Ujjain). Also alongwith the said authorization minimum two certified service engineers having Company ID/Certificate of appreciation letter/ appointment letter as a proof will be required. Regarding above necessities all relevant proof documents should be produce in tender submission. For biometric machine tenderer should have proper specific authorization will also be required for tenderer submission and technical evaluation. The bidders are requested to go through the tender document instructions and various terms and conditions. It may be noted that no conditions or stipulations to the contrary or which are inconsistent will be accepted. Bidders are requested to ensure that all such schedule alongwith questionnaire (duly filled in) are submitted alongwith their offer. The bidder should also note that in absence of any of the schedule, their offer likely to be rejected. Here are some of the very important instructions which every bidder should read carefully for compliance before submitting his bid. I. The tenderers should note that the technical bid submission shall also be the part of services like supply of necessary technically manpower, supply of items , monitoring, comprehensive maintenance, handling and controlling by dedicating technical manpower should available in Simhasth for service delivery etc. II. The tenderers should have mentioned the availability of prospective items in quantity mentioned in schedule –I. III. Tenderers should also note that they should have statutory registration (Company/society/organization/Firm). Proprietorship firm shall not be considered. IV. The Tenderers should have enclosed each statutory documents related to PF,ESIC (optional, but if non availability such with tenderer then CEDMAP shall use their own internal arrangement in the case of manpower supply), Service Tax, TAN no., PAN no., SALE Tax no. any other taxes and duties, any others statutory documents if available. V. The tenderers should signed all the pages of tenders documents before submission as token of having read, accepted and understood the terms & conditions. VI. The CEDMAP will decide the financial of all services of this tender and it will awarded only to those tenderer who are technically qualified as per this tender terms and condition. Such financial shall be valid upto one year from the date of award the work to successful tenderer. VII. The tenderer should bind for giving services in Simhasth -2016 but service period may be below one year i.e. may be upto two months or onward as per requirement in Simhasth. During the period of one year any time work may close, thethe successful tenderer shall not enforce to CEDMAP for carrying the work upto period of one year.

Due to Ujjain Simhasth2016 very soon started and necessary arrangement by CEDMAP to be take care, therefore in tender process, if found, single tenderer bided, however CEDMAP shall consider for technical evaluation and shall awarded the work to successful bidder. Unsuccessful bidder shall not raise any objection in this matter and CEDMAP will have sole rights to take the decision. The tenderer should have to ensure required manpower, necessary infrastructure as per Simhasth need time to time with prior arrangement. If fails the CEDMAP shall keep rights to close the work order with penalty and forfeits the EMD and other payable dues will not be paid by CEDMAP and any claims of tenderer shall not be entertained. However in such situations CEDMAP shall free to award the work to another eligible tenderer with immediate effect so that Simhasth work may not affected and protected for smoothen. If Simhasth 2016 department charged the penalty to CEDMAP due to whatsoever reason, the same penalty shall be applicable to tenderer and tenderer should not argue/ oppose to CEDMAP by legally/any letter of correspondence. CEDMAP will not entertain to tenderer request in this concern. The tenderer should also note that their work controlling/coordination will be fully monitored by CEDMAP regional Indore Head and their officers’ team appointed in Indore and Ujjain. However also controlling will be done by CEDMAP HO, Bhopal. Therefore tenderer should have to maintain the hierarchy for coordination and reporting. The responsibility of Simhasth activities implementation, coordination through tenderer fixed up of CEDMAP’s RTC Indore for which CEDMAP RC Indore and District coordinator shall be nominated by Executive Director, CEDMAP accordingly they will be responsible for implementing the project through tenderer As tenderer should mention the availability regarding arrangement for deployment of infrastructure, manpower as per the quantity mentioned in tender. Based on that Technical evaluation will be done. The tenderers services will also includes the technical manpower for maintenance and dedicatedly should available in Simhasth. The tenderer should have to protect deployed infrastructure as well as manpower by insurance ( if any) , so that any liability should not raised to CEDMAP by tenderer. The tenderers should also note that once infrastructure deployed in Simhasth, if any circumstances happen regarding theft/physically damaged/Natural disaster, that losses responsibility will solely of tenderers. CEDMAP HO shall not bear any losses of tenderers, so the security of tenderers infrastructure shall be of tenderers. The tenderers should also note that the deployed Manpower related if any circumstances happen regarding death/ accident/any other physical damages, in this case all the relevant legal issues like compensation/claims/ labor law act related issues shall be sole applicable to tenderers. CEDMAP HO shall not be responsible to bear the issues in terms of financially/ legally. The tenderers should also note that the submission of tender should not submit in consortium by tenderers. The tenderers should also note that the committee constituted for evaluation of tenders by the tender inviting authority shall evaluate the technical bids with reference to the technical requirement should be eligible, otherwise treated as a rejected . The tenderers should also note that as per services defined in the tender, for award of contract CEDMAP HO will selected as per technical evaluation marking. In case, in technical evaluation the same marks to more than one bidder, for which the committee decision will be full and final based on discussion with concern bidders or in this case winning bidders shall be selected through lottery. The tenderers should also note that the salary of manpower and their legal submission shall be handled by CEDMAP HO, in these concern tenderers services charge shall be paid by CEDMAP to tenderers from the head of CEDMAP service charge approved by Simhasth authority. For which tenderers shall have the sole responsibility about properly they maintain the attendance of Manpower and its should certified by Simhasth competent authority and for salary process should be forward to CEDMAP HO in proper time so that timely payment should be made to concerns. However CEDMAP have reserve the rights for tenderer may be assign salary distribution work to manpower with their statutory liability submission through statutory license of tenderer/any other agency. The tenderers should also note that CEDMAP HO shall have the sole rights about cancel the tender before or after bidding and tenderers arguments (verbal/ written) shall not be entertained by CEDMAP HO and CEDMAP HO shall not be communicate any reason to tenderers in this concerns. The tenderers should also note that if mentioned projected infrastructure quantity reduces in award of order from CEDMAP HO, however it may increase or decrease, in such situation tenderers objection shall not be entertained. The Tenderers should note that the quoted items in quantity should be readily available with successful bidder without delay. The tenderer should also note that if CEDMAP HO, Bhopal demand raised for other than Simhasth work then that shall be part of this tender. VALIDITY OF BIDS:-

Offers should be kept open for acceptance for at least one year from date of award of order from CEDMAP HO, Bhopal. Those who not agree for a validity of one year will do so at their own risk and no request for extending the validity is likely to be made from this office. However, if due to any circumstances, beyond control, tenderers are advised to extend the validity, they shall not be permitted for financial revision.

1.2. JURISDICTION OF COURT : Legal procedings, if any, shall be subject to courts under Bhopal jurisdiction only.

1.3. CRITERIA FOR EVALUATION : Evaluation of Technical Bids: A- As per key dates of tender, shall be opened and the eligibility shall be assessed as per tender criteria for evaluation. The bidders shall be requested to furnish following documents for technical bid:1- Copy of firm/organization as a registration with Memorandum/Bio laws. 2- Copy of latest Income Tax return/Permanent Account Numbers (PAN) of Firm/ organization along with names, addresses and telephone Nos./Mobile Nos. of Directors. 3- Copy said authorizations, channel partner/ partnership deed, copy of office ownership etc and documentary proof is mandate for minimum 05 years said experience for technical bid. 4- Copy of list of directors (in case of a company) with names, qualification, addresses and telephone Nos. /Mobile Nos. of each director. 5- Copy of list of Employees with names, qualification, addresses and telephone Nos. /Mobile Nos. of each employee. 6- Copy of Govt. experience order copies. 7- Copy of 3 years audit 1.5. EARNEST MONEY1- The tenderer shall be required to deposit an interest free amount of Rs. 30000/- (Rs. Thirty thousand only) towards Earnest Money Deposit along with the Tender documents in the form of Demand Draft of nationalized bank only in favour of CEDMAP, Bhopal payable at Bhopal. The EMD of unsuccessful tenderes shall be refunded after finalization of the Contract. For successful bidder deposited earnest money will be converted to Security Deposit and will be released after completion of contract period. 2. The EMD may be forfeited in case the contractor accepts the Work Order of the CEDMAP, but does not turn up to take over the contract within the stipulated time, or withdraws his bid subsequent to the opening of the tenders.

2.1. The EMD may be forfeited:(1) If a bidder withdraws or revokes its bid during the period of bid validity specified by the bidder; (2) If a bidder modifies its bid in any manner after its opening but before the validity of the bid expires; (3) If a bidder does not accept the arithmetical corrections of its bid price; (4) In the case of successful bidder, if the bidder fails to; - sign the contract within the prescribed time; - furnish the security deposit within the prescribed time otherwise EMD shall be converted in security deposit of this tender. (5) In case, the bidder withdraws his offer during the validity period, after

• Income Tax Act and other applicable law/regulation. The CEDMAP HO, Bhopal reserves the right to recover any amount due for whatsoever reason from the bill(s) submitted by the tenderer. - Following necessary documents required along with monthly bill and information should know about CEDMAP submission through proper coordination. i. Attendance sheet verified by Simhasth competent authority. ii.Any other documents required as per company procedure of rule.

2.2. PENALTY:The penalties will be imposed on violation of terms and conditions of agreement as per the list given below: S.No. Description of Irregularities Penalty 1

If the necessary infrastructure and manpower deployment fails by tenderer, in such situation if Simhasth authority/ CEDMAP District officer/Regional officer/CEDMAP HO officer imposed any penalty through letter that would be applicable for deduction of penalty amount from tenderer payable.

If tenderer fails to comply with observation/remarks repeatedly three times in a month or any representative supervisor/staff of tenderers misbehaves with CEDMAP’s official, the contract shall be terminated and additional penalty of Rs. 20000/- shall be deducted from security deposit/bill payments with termination of contract from immediate effect, CEDMAP may engage another tenderer after required negotiation to avoid cumbersome tender process in order to restoration of services. Any delay in or failure of the performance of the either parties to the contract shall not constitute defaults or failure in performance in caused by occurrence due to act of God or public enemies, exploitation of confiscation by the Government Authorities, compliances any other or request of any Government Authorities, act or war, rebellion or sabotage or fires, flood, explosions, riots or legal/illegal strike/lock outs, natural calamities etc. 2.3. SECURITY DEPOSIT :The EMD amount of successful bidder shall be treated as a security deposit of this tender. at the time of agreement in the form of FDR/Bank guarantee of nationalized bank in favour of "CEDMAP" Bhopal payable at Bhopal. No interest shall be paid on such security deposit, which shall remain with CEDMAP Bhopal during the continuance of the contract and it shall be released after the expiry or termination of the contract, subject to clearance of all dues by the tenderer.

2.4. EXTENSION ORDER The CEDMAP Bhopal reserves right to place an extension order on same rate of selected tenderer. 2.5. COMMENCEMENT OF THE WORK: The work shall be commenced from the date mentioned in the Work Order. In anything happen due to fault of their staff, then same shall be recoverable from tenderer. 2.6. SETTLELMENT OF DISPUTES:All suits or proceedings relating to any dispute or claim arising out of or in the course of performance of the contract, shall be filed only in the competent court at Bhopal only. 2.7. ARBITRATION :If, at any time, any question, dispute or difference, whatsoever shall arise between the CEDMAP and tenderer, upon, or in relation to or in connection with the contract, either party may forthwith give to the other, notice in writing of the existence of such question, dispute or difference, and the same shall be referred to the adjudication of two Arbitrators, one to be nominated by the CEDMAP and the other to be nominated by the tenderer. In the case of said Arbitrators not agreeing, the matter shall be referred to the adjudication of an Umpire, to be appointed by the Arbitrators, whose, decision shall be final and binding on the parties. The arbitration shall be conducted as per provision of The Madhya Pradesh Madhyastha Adhikaran Adhiniyam1983, as amended from time to time, and of the rules made there under. The Arbitrators or the Umpire as the case may be, are bound to give a detailed speaking award assigning reasons for the findings. Tenderer services under the contract shall be continued by the tenderer during the arbitration proceedings, unless otherwise, directed in writing by the CEDMAP or unless the matter is such the work cannot possibly be continued until the decision of the Arbitrator or of the Umpire, as the case may be, is issued. The arbitration proceeding if any shall be strictly held at the head quarter of CEDMAP at Bhopal. 18. The CEDMAP reserves the right to accept/reject wholly and partly any tender without assigning any reason, whatsoever. No correspondence in this.
