Public Liability Insurance In entering into this agreement Mildura City Committee of Management and Mildura Rural City Council are faced with many risks over which they have no control. It is therefore mandatory for you to take out, and maintain current for the period of the casual leasing of the facility, public liability insurance to the value of $10 million minimum. A copy of your public liability “certificate of currency” MUST be provided with this letter of application detailing the following: Insurance Company, Policy Number, Amount of Cover and Policy Renewal Date. Please discuss the above insurance requirements with your insurance company or broker if you are unsure of the requirements required by Mildura City Committee of Management and Mildura Rural City Council. 13. TERMS AND CONDITION OF CASUAL LEASING 1. Payment (a) If the hirer requests a vacant shop front a fee will apply. This amount is to cover cleaning of the premises. (b) This Leasing Fee must be paid to Mildura City no later than seven (7) days prior to the commencement of the hiring period. (c) All payment should be made by way of cheque or direct deposit to Mildura City Traders and forward to 132C Eighth Street, Mildura, Victoria, 3500. EFT payments are also accepted. 2. The Approved Display (a) The Hirer may erect a temporary display. Such Display shall be Professional, high class nature and shall in no way detract from the standard of the Langtree Mall. (i) The Hirer shall ensure that all trestles are fully covered at all times (ii) The Hirer must display professional signage and under no circumstances is handwritten signage to be erected. (b) The Display must be of a temporary nature and the hirer must not affix items to any part of the paver’s of window space. (c) The Hirer must not allow any part of its display to stain, mark or damage the floors of the mall or window space. (d) The Mall Management reserve the right to require the hirer to remove or alter any part of any display erected on casual letting. (e) Prior to Take Date, the hirer must: (i) Remove the Display, and all fittings equipment or other articles from the casual letting. (ii) Reinstate the Casual Letting to its condition prior to the Set Up Date (iii) Make good any damage caused by it to the Casual Letting (iv) Remove all rubbish and leave the Casual Letting in a clean state and condition. 3. Food Displays (a) All Licensees employees are to be hygienically attired. (b) All food wastes are to be placed in sealed hygienic containers and disposed of appropriately. (c) Mats are to be placed under and around cooking displays and after removal, floors are to left slip free. (d) The public is to be protected at all times from hot appliances by shielding to be erected at the cost of the hirer. 5. Risk The Hirer accepts that it occupies the Casual Letting at its own risk and the owner and the Mall Manager shall not in any circumstances be liable to the hirer for any damages suffered by it or its property. Mildura City will not store or stock items on behalf of the hirer and the hirer must make its own arrangements in this regard. 6. Termination Should the hirer breach any of these terms of Casual Letting, the Mall Manager on behalf of the owner may terminate the Casual Letting Agreement without further notice. 7. Cancellation The Hirer may cancel the Casual Letting by notice in writing to the Centre Manager at least seven (7) days prior to the set up date. Any notice given after such time will not release the Hirer from its obligations under the casual letting agreement and it will remain responsible for all fees payable under the agreement. 8. Owner’s Right The Owners have the right to move or cancel any Casual Letting agreement at any time without notice.

The product or display must be approved by centre management. If you cancel the booking within 7 days prior to the start date, you must pay us a cancellation fee of 10% of the booking fee (if applicable). The Licensee must provide a current copy of their certificate of currency for Public Liability Insurance (minimum of $10 million dollars). The Casual Lease Application Form must be fully completed and returned to Mall Management 7 days prior to set up. Full Payment must be received 7 days in advance. Cheques are to be made payable to Mildura City Traders. All Special requests must be approved prior to commencement date, (eg Trestles, Storage Space) Set up and pull down times must be in normal working hours. If the licensee is unable to utilise this time, they must consult mall management for other arrangements. All vehicle movement within the mall space must be at walking pace, hazard lights on and escorted by a person wearing high visibility vest to caution pedestrian traffic.
