Foreword The Commission for the Disappeared and Victims of Violence (KontraS) has been monitoring the use of the death penalty in Indonesia since 2005. This report is based on primary and secondary data obtained through KontraS’ advocacy efforts. Official government data regarding the implementation of the death penalty in Indonesia is unavailable, although most post‐New Order cases are reported on in the Indonesian press. KontraS opposes the death penalty in all circumstances. The death penalty violates the right to life and is the ultimate form of cruel, inhuman and degrading punishment. Only abolition of the death penalty can guarantee that no innocent person is executed. Although far from perfect, we hope that this record can provide information about the application of the death penalty in Indonesia, providing transparency for Indonesians and the international community alike. We also hope to use these records to undertake strategic advocacy work to encourage the elimination of the death penalty in Indonesia and around the world. Jakarta, June 2013 KontraS Working Body

I. Introduction Indonesia’s recent pivot towards increased use and implementation of the death penalty, in stark opposition to the current global trend toward abolition, is deeply troubling, to say the least. Earlier this year we published a piece in the Jakarta Globe commending Indonesia’s recent strides towards abolition.1 Yet since that time Indonesia has increased both the number of death sentences being handed down by district courts and the Supreme Court. Tragically, they have also been executing prisoners again after a four‐year moratorium. As of the date of the publication of this report, four prisoners have been executed in three months, and the Attorney General has announced their plan to execute even more before the year is up. The government’s decision to ramp up executions only puts the hundreds of Indonesians facing the death penalty overseas at greater risk. In the past few years, Indonesia has increased its advocacy for migrant workers facing the death penalty in countries like Malaysia and Saudi Arabia. Their sudden decision to resume executions, then, makes the nation’s stated policy to protect and support migrant workers appear confusing, at the least, and hypocritical, at the worst. The only way to halt State‐sponsored homicide andmove Indonesia in line with the rest of the global community is to abolish the death penalty outright. KontraS hopes to contribute to the conversation about the abolition of capital punishment in Indonesia by providing the public with data. II. Why KontraS Rejects the Death Penalty KontraS has consistently rejected capital punishment as cruel and inhuman.2 The death penalty violates international human rights standards: most importantly, the right to life. This is a non‐ derogable right, meaning that it cannot be violated, reduced or restricted under any circumstances, including in cases of emergency, war or prison confinement. Indonesia signed the Universal Declaration of Human Rights and the President ratified the International Covenant on Civil and Political Rights (ICCPR). Both of these documents assert the right to life and outline a state’s duty to guarantee it. Unfortunately, ratification of the ICCPR was not followed by the ratification of the ICCPR Second Optional Protocol aimed at the abolition of the death penalty. Other human rights violations often also come into play in death penalty cases, including the right to be free from cruel and unusual punishment, especially torture. Of a particular concern is the long period of time between sentencing and the actual execution. The European Court of

Human Rights declared that extended periods on death rowviolate human rights norms.3 Many of Indonesia’s 130+ death row prisoners have been awaiting execution for ten years or more. One Indonesian prisoner died of natural causes in 2012 after being sentenced to die in Sumatra in 1970 (see page 15 of this report for more information). The application of the death penalty in Indonesia is also contrary to the development of civilized nations of the modern world. Amnesty International notes that, as of December 2012, 140 countries have abolished the death penalty, or more than two‐thirds of the world.4Africa has been the most active region in the abolishment of the death penalty. Many African countries share a similar culture, political system and social structure with Indonesia. Abolition of capital punishment through legal and political mechanisms would raise the dignity of Indonesia in the eyes of the international community. Indonesia should abolish the death penalty for the following reasons: 1. Death penalty not a deterrent to crime ‐ It is a sociological reality that the death penalty fails as a deterrent to crime when compared with similarly harsh punishment.5 A United Nations study looking at the murder rate between 1988 and 2002 found that capital punishment does not reduce crime any better than a life sentence. The rise of narcotics, terrorism and other violent crimes is not related to the death penalty, and instead are correlated with external factors such as poverty or a weak/corrupt state. These studies are consistent with the rise in drug trafficking in Indonesia despite the existence of the death penalty. For example, in 2005 Indonesian officials discovered a factory in Cikande, 60 kilometers west of Jakarta, which manufactured methamphetamines and MDMA (ecstasy) for the international market. The Cikande plant was believed to be the third largest ecstasy factory in the world at that time, producing 100 kilograms of ecstasy per week with a value of about $100 billion USD.6 It was later discovered that two police officers were involved in the scheme: Commissioner Damanik and Assistant Commissioner Girsang.7 Despite the existence of the death penalty in Indonesia and the regular prosecution of drug mules caught trafficking, the amount of drugs being brought into the country has been on

the rise. By April of 2013, customs officials had already seized almost the same amount of drugs this year as they had in the entirety of 2012.8 2. Death penalty not a deterrent to terrorists ‐ The threat of the death penalty has not proved an effective tool in the War on Terror. Indeed, the penalty has strengthened ideological radicalism and spurred terrorists to militancy. A statement by terrorist IwanDharmawan alias Rois, convicted for the bombing of the Australian Embassy in Jakarta that killed 9 people on 9 September, 2004, illustrates this well. He stated before the South Jakarta District Court, as he was being sentenced to death, on November 13, 2005: I am not surprised with this verdict because I already presumed from the beginning that I would end up a criminal defendant. I reject this verdict because it was ordered by this devil court, pursuant to the devil’s law, not Allah’s law. Even if I am executed, this means I die a martyr.9 Other terrorists have echoed similar sentiments, refusing to ask for pardon or forgiveness for their crimes.10 Thus, the death penalty does not seem to have the desired deterrent effect in cases of terrorisms. Authorities seem to have caught onto this, and appear now to rely on extrajudicial killings to eliminate terrorist cells. Notably, there are only two convicted terrorists sentenced to death, despite regular raids of terrorist cells by Densus 88, the elite Indonesian anti‐ terrorism brigade. This is in large part because few of the suspects tracked down by Densus 88 ever make it to trial; many are gunned down in the field.11 3. Unfair trials create high probability of the execution of innocents ‐ Indonesia has not yet shown its justice system to be an independent, impartial and/or a clean apparatus. A weak justice system increases the odds of a death sentence born out of an unfair trial and can lead to the conviction of innocents. The case of Sengkon and Karta, who served six years in

prison before they were declared innocent in 1980,12 are a bitter reminder that the law, as a man‐made institution, is fallible. 4. Death penalty at home hurts Indonesians facing the death penalty overseas ‐ Over two hundred Indonesian citizens are facing the death penalty in other countries. 13 The Indonesian government has been active in advocating for their release and the Indonesian public has also become deeply invested in protecting migrant workers who get into trouble overseas. In order to properly advocate for these Indonesians, the government cannot continue to execute Indonesians and foreigners at home. III. The Death Penalty System in Indonesia Though the death penalty has been codified as an authorized punishment from the inception of the Republic of Indonesia, the first official execution did not take place until 1973.14 A criminal defendant who has been sentenced to death in a district court can appeal to the relevant high court and to the Supreme Court. It also occurs that a defendant will be sentenced to something less than death, but on appeal either the high court or Supreme Court sentences them to death. A person may technically only appeal for clemency only once, except in cases where more than two years have passed since a clemency decision was rejected, in which case a new appeal may be lodged.15Some prisoners re‐file for clemency under a new president even if the former president declined their petition. Executions in Indonesia are by firing squad and are not fast or painless. A condemned prisoner only learns of his impending execution 72 hours before he is to be executed. According to CNN: The firing squad of around 10 police from the elite paramilitary mobile brigade will have spent the days ahead of the execution practising using human‐shaped targets. [Thecondemned prisoner] will then be hooded and a reflective marker will be placed over her chest to enable the shooters to see their target. The firing squad will take aim and then shoot through the heart from a meter

away.16 Prisoners are currently facing the death penalty for three crimes: premeditated murder, narcotics, and terrorism. For the complete list of crimes allowing for the death penalty in Indonesia, see Table 2.
IV. Capital Punishment Statistics in Indonesia This report serves as an update to the statistics about the death penalty that KontraS published in 2010. The Attorney General’s Office stated in December 2012 that there were, as of that date, 133 people facing the death penalty: 71 for drug charges, 60 people for murder convictions, and 2 for terrorism.17 KontraS’ records show that there are around 130 people who we believe to be currently facing the death penalty: 60 for drugs, 68 for murder and 2 for terrorism. They are listed in Tables 2‐4 in the Appendix. a. The Death Penalty by Nationality According to our data, the prisoners on death row include 41 foreign nationals, 40 sentenced to death for drug crimes and one Malaysian citizen sentenced to death for murder. These foreign inmates come from 18 different countries: Australia, Brazil, China, France, Ghana, Great Britain, India, Iran, Malawi, Malaysia, Netherlands, Nigeria, Pakistan, Senegal, Sierra Leone, the U.S., Vietnam, and Zimbabwe. Indonesian death row prisoners come from all over the archipelago, but overwhelmingly from Java and Sumatra. b. The Death Penalty by Region We organized the data of known cases by region and by type of case (murder, drugs and terrorism). Nearly half of all the death sentences in capital murder cases come from Sumatra, followed by Java, Kalimantan, Bali and the Military Court System.

On May 17, the State executed three more prisoners. SuryadiSwabhuana, Juritbin Abdullah, and Ibrahim bin Ujang, all Indonesians from South Sumatra, were put to death by firing squad in Nusakambangan prison, on an island off the coast of Java.18Suryadi alias Edi Kumis alias Dodi bin Sukarno was sentenced to death for a 1991 murder/robbery in Palembang in 1992. His petition for clemency was denied in 2003. Jurit and Ibrahim were sentenced to death for a 1997 murder/mutilation case by the Sekayu District Court in 1998.19Their pleas for clemency were denied in 2008.20 Co‐defendants in the case, Sofyan Bin Abdul Manap and Muhammad Dani Bin Abdul Manap, were both sentenced to 20 years in prison. No executions occurred in Indonesia from December 2008 – March 2013. In 2008, nine individuals were executed throughout the republic. See Table 1, Appendix. Notably, 2008 was the year before the Presidential elections. It is no coincidence that defendants from relatively prominent cases, in particular the Bali bombers, were sent before the firing squad in November 2008, not long before voters hit the polls on July 8, 2009. Current President SusiloBambangYudhoyono was re‐elected to a second term that year. The next presidential elections will take place in 2014. d. New Death Sentences: 2010-2013 At least ten new death sentences have been announced in 2013 as of the date of publication for this report. We have details about the following: • On January 22, 2013 Ms. Lindsay Sandiford, a British citizen, was sentenced to death for drug trafficking by a Bali court. The prosecution asked for a 15‐year sentence. But the judges decided instead to give her the maximum penalty: death. Her four co‐ defendants were all given sentences in terms of years.21 • On January 30, 2013 Mr. Muhammad Rizal, age 41, was sentenced to death by the Pekanbaru District Court in Riau, Sumatra for the murder of a father and son. The prosecutors asked the Court for a life sentence, but the court sentenced him to be executed by firing squad.22

In North Jakarta District Court, two alleged drug kingpins were sentenced to death. On February 6, 2013 Mr. GanKuo Lien alias Peter was sentenced to death for dealing 279 kilos of shabu (meth). On February 12, Malaysian citizen Mr. Ewee Hock alias Jerry was sentenced to death for being found with 9 kilos of shabu on him. Their co‐defendant, WijdanulWidan alias Aong, was sentenced to life in prison.23

On March 6, 2013, the Indonesian Supreme Court (MA) sentenced drug dealer Mr. HartawanLunardi alias Akui or Jhonto death (Case no. 2469 K/PID.SUS/2012). Mr. Hartawan was convicted of drug trafficking after police seized 275,055 ecstasy pills.24It is unclear whether or where he was originally sentenced, and whether the MA was merely upholding the lower court’s verdict or imposing a death sentence for the first time.

The MA sentenced Malaysian citizen Mr. KwehEikchoon, age 35, to death. The MA’s decision was released on April 21, 2013. The Tangerang District Court had initially sentenced him to 20 years. On appeal to the Banten High Court, the sentence was reduced to 12 years. According to the MA, his sentence was increased to the death penalty because of the court’s concern for the effect of drugs on Indonesian youth. Police seized more than 358 kg of ecstasy and 48.5 kg of shabu from his Jakarta apartment.25 The Bandung Military Court II‐09 sentenced 2nd Pvt. Mart AzzanulIkhwan, age 23, to death on April 24, 2013. The military prosecutors, or oditur, had recommended a sentence of 20 years in prison. He was convicted of the February 2013 murder of two women: a pregnant woman who claimed he was the father of her unborn child, and the pregnant woman’s mother who threatened to file a report with his superior if he didn’t take responsibility for the child.26

The Supreme Court unanimously sentenced Mr. RahmatAwafi, age 26, to death on April 30, 2013. He was convicted of the 2011 murder of a woman and her child in Jakarta. He was sentenced to 15 years by both lower courts.27
KontraS learned that at least 11 new death sentences were handed down in 2012. • Mr. EfranFeriFerdiansyah and his wife, Ms. Milna, both 27, were sentenced to death by the Prabumulih District Court in Southern Sumatra for the crime of premeditated murder on March 15, 2012.28 The prosecutors had asked for a life sentence and 20 years, respectively, but the Court sentenced both to death.29 • Mr. Gareth Cashmore, a British national, had his sentence increased from life imprisonment to death by firing squad by the Banten High Court on May 15, 2012.30 • Mr. Liong Kim Ping, a Malaysian citizen, was sentenced to death in the Kalianda District Court in Lampung, West Java on July 17, 2012 for possession of 45 kilograms of methamphetamines and 1700 ecstasy pills.31 • An Iranian citizen, Mr. Akbar ChaharKarzae alias Mohammad Baluch, was sentenced to death by the Cibadak District Court in Sukabumi, West Java in August 2012. He was convicted of trafficking 60 kilograms of methamphetamines (shabu‐shabu).32 • On September 19, 2012 the Kalianda District Court in Lampung, West Java, sentenced truck driver Mr. Enrizal, 45, to death for trafficking marijuana. His co‐defendant, Mr. JuniArdiwan, age 39, was sentenced to life in prison.33 27

Mr. HeruHendriyanto, 25, and his wife Ms. Putu Anita SukraDewi, 23, were sentenced to death by the Denpasar District Court for murdering their employers on November 6, 2012.34Mr. Muhammad Kadir, alias Abdul Kodir, age 36, and Mr. Safa'at, alias Fa'at or Herman, age 32, were sentenced to death for their role in the same crime in the same court on November 12, 2012.35

The Tangerang District Court sentenced Mr. MuhamadSoleh, aliasOleng (age 28), to death for the murder and gang‐rape of a female university student on December 18, 2012.36 His crime was made noteworthy in the press because he allegedly stomped on the Koran during the trial.37His five co‐defendants were all sentenced to 20 years in prison.
At least 6 people were sentenced to death in 2011: 5 for murder and 1 for drug trafficking. • Mr. Ade Saputra was convicted of the rape and murder of a student named Siska by the Padang District Court in West Sumatra on July 5, 2011.38 • Mr. Edwin Rahadi, an ecstasy manufacturer and convicted murder, received the death penalty from the Supreme Court on July 23, 2011. In 2010 he was convicted for the murder of Ms. UrayQori by the Pontianak District Court in East Kalimantan and sentenced to life in prison.39

Mr. AndiBustan, alias Andi Mamma, was convicted of the murder/mutilation of his aunt, AndiOndong, by the Parepare District Court in Southern Sulawesi on November 1, 2011.40

Mr. Misnari and Mr. Miarto were convicted of the robbery‐murder of four individuals by the Probolinggo District Court in East Java on November 15, 2011.41Three accomplices were given lesser sentences for their role in the robbery.42

Ms. Tran ThiBichHanh, a 34‐year‐old Vietnamese citizen, was convicted for drug trafficking by the Boyolali District Court, Central Java, and sentenced to death on November 22, 2011.43

Some defendants have their sentences decreased during the appeals process: • Indonesian ecstasy factory owner and drug trafficker, Mr. HengkyGunawan, was re‐ sentenced to 15 years after the Supreme Court determined that his death sentence violated the Constitution.44 • Nigerian national Mr. Hillary K. Chimize(sometimes spelled Chimeze) also had his death sentenced overturned by the Supreme Court. He was re‐sentenced to 12 years in prison. In 2008, three of the Bali Nine, Australian citizens Mr. Matthew James Norman, Mr. Si Yi Chen and Mr. Tan DucThanh Nguyen, were spared the death penalty and re‐ sentenced to life in prison.46

Mr. Stephen RasheedAkinyemi, from Nigeria, had his death sentence commuted in 2004 to a 20‐year prison term.47

According to a Nigerian newspaper, Nigerian citizen Mr. Ken Michael is serving a life sentence.48

in 2002 for the 2001 Atrium Shopping Mall bombings in Central Jakarta.51It seems that a factor in reducing Mr. Taufik’s sentence was the fact that he lost his leg during the bombing.52 •
Ms. TuminiSuradji, wife of infamous Indonesian serial killer Mr. Ahmed Suradji (executed in 2008), had her death sentence reduced to life in prison.53
ii. Clemency
President Yudhoyono granted clemency to three individuals facing the death penalty in the last two years. • President Yudhoyono pardoned Mr. IndraBahadurTamang, a citizen of Nepal. He is now serving a life sentence for trafficking 900 grams of heroin. He had earlier petitioned for clemency and was denied by President Megawati in 2001.54 • Ms. MeirikaFranola, alias Ola, was granted clemency on September 26, 2011. She is now serving a life sentence for trafficking 1.1 kilos of heroin. The President was later criticized for this decision when it was learned that Ms. Franola was running drugs from her jail cell in Tangerang Women’s Penitentiary.55 • Mr. DeniSetiaMaharwa, sentenced to death by the Tangerang District Court on Aug. 22, 2000, was granted clemency in October 2012. His sentence was commuted because

iii. Deceased
Since our last report in 2010 it has come to our attention that several capital defendants have died. • Ms. BunyongChausaArd, from Thailand, died in 2006.57 • Ms. Edith YunitaSianturi, Indonesian, died from complications with HIV on April 26, 2009.58 • Banged (or Benged) Siahaan, a transgender Indonesian, also known as Lilis, died on May 26, 2009.59 • Malaysian citizen Mr. Tham Tuck Yin, alias A. Tijai, died on September 9, 2012 of hepatitis B at Nusakambangan Prison. He was 47 years old.60 • Mr. Bahar bin Matar, Indonesian, died on August 12, 2012 at Nusakambangan Prison at the age of 69. The Riau District Court in Sumatra sentenced him to death on March 5, 1970 for the crime of murder.61 56

V. Looking to 2013 In a statement on February 2, 2013, Attorney General BasriefArief said that 12 inmates could potentially face the firing squad in 2013.63Indonesia’s next presidential election will occur in 2014. If a dearth of executions does occur this year, this would be consistent with the pattern set before the last presidential election. The high cost of executing prisoners may stand as a potential barrier to executions in 2013. According to the Attorney General’s Office in October 2012, the cost of every execution is Rp. 100 million, or US $ 10,310. Attorney General BasriefArief stated that there was at that time no budget for executions and stated that the AG’s Office would make a proposal for funds dedicated to executions.64It is unclear, what, if any, impact this would have on the AG’s decision to follow‐through with the 12 impending executions. Despite the backlog of death penalty cases and the high costs of executions, KontraS has no reason to believe that courts will stop handing down sentences, either at trial or on appeal, as indicated by the two new capital sentences from January and February 2013, respectively. The recent execution indicate the Attorney General’s Offices desire to go through with the threatened executions. Thus the only way to end the death penalty in Indonesia will be to abolish it outright. VI. Recommendations KontraS recommends that the government take the following steps: 1) Abolishthe death penalty, in accordance with UNCommission on Human Rights resolutions, by declaring a moratorium on allexecutions; and commute all pending death sentences to terms of imprisonment. 2) Amend all relevant articles of Indonesia’s Criminal Code (KitabUndang‐ undangHukumPidana, KUHP) so that they do not provide for the death penalty. 62

3) Take concrete steps to ensure that all prosecutions, in particular those for crimescarrying the death penalty, meet the highest international standards for fair trial. Thiswould include the right to adequate legal representation at every stage of proceedings,adequate access to interpretation and freedom from torture or ill‐ treatment. 4) Facilitate an informed public debate about capital punishment, including its lack of aproven unique deterrent effect, and about alternative methods of dealing with law andorder in a way that is consistent with human rights standards.
