Welcome to Budapest, A UIA congress is always a special time for knowledge sharing, conviviality and openness to other cultures, with no set pattern or single mind-set. Budapest is a very modern city that is also steeped in history, which needs to be discovered at a gentle walking pace. It is not very far from the banks of the Danube and the modern hotels in the heart of Buda and Pest to the city’s historic sites. One of the main themes, that of compliance, will be making headlines as transposition starts of the Fourth European Directive of May 20, 2015 on the prevention of money laundering and terrorism financing. Lawyers, who are guardians of civil liberties, will be discussing the difficult course to be navigated between investigative transparency, privacy protection and business confidentiality. The second main theme is the protection of personal data, a subject that is as sensitive as it is topical, in a digital universe where the dissemination of information is instant and very difficult to control, in particular when confidential documents are sent electronically. These two sessions will be attended by experts and prominent figures, who will share their experiences and delve deeper in the fundamental issues raised by these subjects. Another major event deserves your attention: the meeting of the International Bar Leaders’ Senate, a venue for discussions on our current and future practices, which is reserved for the Presidents of lawyers’ organisations. A UIA congress is also a great place to make friends and to forge lasting business relationships. The UIA takes care to ensure that efficient work goes hand in hand with the pleasure of being together. A quality social and leisure programme has been designed that will enable you to discover the many charms of Budapest. We have all worked very hard to ensure that the Budapest Congress is a success, however this will not be possible without you, so we hope that as many of you as possible will join us in Budapest. Jean-Jacques UETTWILLER UIA President Dear Colleagues, Dear Friends, In my capacity as Congress President and also as a Vice-President of the Hungarian Bar Association and the Budapest Bar Association, I very much look forward to welcoming you all to the UIA 2016 Congress that will be held in our beautiful city of Budapest. Budapest, like Hungary, has a long, rich and often bloody history, largely due to its location on the crossroads between East and West, as well as North and South. The city was first named Aquincum, and was originally a Celtic settlement that became the Roman capital of Lower Pannonia. Nomadic Hungarian tribes arrived in the 9th century and, although the Mongols pillaged their first settlement in 1241 and 1242, by the 15th century, the rebuilt city had become one of the centres of Renaissance humanist culture. After 150 years of Ottoman rule, the area experienced increasing prosperity in the 18th and 19th centuries, and Budapest became a global city after its unification in 1873. It was also the second capital of the Austro-Hungarian Empire. When you visit Budapest, I hope you will agree that the richness of our history is only matched by the beauty of the city itself. Budapest has many World Heritage sites, which include the banks of the Danube, the Buda Castle complex, Andrássy Avenue, Heroes’ Square and the Millennium Underground Railway, which is the second oldest metro line in the world. In addition, the city has around 80 geothermal springs and the world’s largest thermal water cave system, so please do not forget to bring your swimming costumes! Both the Hungarian Bar Association and the Budapest Bar Association are based in the city, and all of their members are committed to safeguarding the fundamental principles that the UIA strives to uphold and maintain. These days, our legal community also has an international flavour, of which we are very proud. We place great importance on increasing and maintaining our integration with the global legal community, which is why it is an absolute pleasure for us to host the 2016 UIA Congress in our capital city. I hope that you will not only take away some new legal expertise, perspectives and business contacts from our city, but also many fond memories of the sights and experiences that Budapest and traditional Hungarian hospitality have to offer. Challenges and opportunities for the legal profession Compliance is one of the most crucial aspects of a company’s structure and operations, as has been highlighted by recent public scandals affecting the reputation of companies. Reputation is the most important asset of a company, and compliance helps to safeguard it. The objective of this main theme is to introduce participants to compliance and its fundamentals, the challenges to compliance, the benefits of a thorough compliance programme, its building blocks, their implementation into a company’s operations, the review and reporting mechanisms and internal investigations if an issue occurs, and to highlight the importance of this area of the law for the legal profession. The U.S. uses a robust and complicated system of trade and currency controls to prohibit dealings with targeted countries, groups and individuals. Budapest 2016 International Bar Leaders’ Senate Corso A + B 2.00 PM - 5.30 PM n SaTURDAY, OCTOBER 29, 2016 Can the protection of confidential client information and the disclosure of information to combat money laundering be reconciled, or are they in fact diametrically opposed? This is a decision that governments, courts and lawyers are increasingly having to face. Some would argue that the attorney-client privilege is a basic value in any democratic society-- a fundamental principle of justice that must be accorded the highest priority. That is the position that was taken by the Supreme Court of Canada in February 2015. Others, citing events that have been occurring with increasing frequency in recent months, contend that priority must be placed on putting a stop to money laundering-- a recognised source of terrorist financing-- and eliminating barriers to unrestricted access to all sources of information. Isn’t this one of the consequences of the adoption of the 4th AML Directive by the European Parliament in May 2015? What position should bar associations and law societies take on this issue? We encourage all of you to attend the meeting of the International Bar Leaders’ Senate, listen to the speakers address the different aspects of this situation, and take an active part in developing the solutions that will hopefully emerge out of this broad exchange of views. Working as we do in an environment that is increasingly open to alternative solutions and negotiated arrangements, is it possible to develop solutions that reconcile these two situations? The session will, in general, be devoted to the issue of government surveillance of citizens for criminal profiling purposes (public aspect) as well as the corporate use of the personal data of clients/users for commercial profiling purposes (private aspect) in the context of a society where the processing of citizen and consumer data is increasingly prevalent. These issues are certainly common to many countries and the challenge is how to ensure effective protection of the fundamental right to privacy and the protection of data in the public and private sector, while including the protection of lawyers’ professional privilege in response to electronic surveillance. An international approach to this issue is required and must be implemented at various levels (governments, corporations and international organizations, for example), as was the case in the UIA resolution ‘Privacy in Digital Communications’ adopted at the Valencia Congress in 2015. This theme is the result of a deep reflection within the UIA.

Economic Sanctions and International Arbitration Our session will focus on legal and practical considerations in addressing issues arising from economic sanctions. The programme will consist of two panels. The first will examine the notion of economic sanctions, their sources and their relevance to international arbitration. The topic will be approached from the perspectives of counsel, arbitrator and arbitral institution. The second panel will look at the impact of economic sanctions on a dispute when applied as the lex contractus or as mandatory law, the enforcement of sanctions ordered by arbitrators and various issues related to the enforcement of arbitral awards.

3D Printing - the Shape of Things to Come 3D printing will revolutionize design, (re)production and distribution of everything from toys to medical devices, from fashion goods to tools and from weapons to art. Increasingly affordable and versatile, 3D printing offers once unimagined opportunities, like “printing” prostheses for amputees in remote, impoverished places. But it also creates new challenges, e.g., for IP owners, suppliers and distributors, and product-safety regulators. Even police agencies must consider such dangers as cheap, printable guns that metal detectors cannot identify. Can the 3D printing industry itself be of any help?

Can We Have it All? Issues Related to Remote Working and Flex-time New technologies have opened a wide range of possibilities for employees to work remotely. At the same time, new legislation is allowing flexible working time and part-time arrangements. Whilst this provides both employees and employers with flexibility, it also raises a good number of issues that will be analysed in this working session, including monitoring working time – straight time and overtime; work intrusion on employees’ privacy; zero-hour contracts vs exclusivity obligation; family-friendly rights; and health and safety.

SUNDAY, OCTOBER 30, 2016 THeME Origin of Processed Food Products Loss of trust in the European Union leads several member states to put in place legislation making origin labelling of food products mandatory. Currently at the top of the agenda, the issue of origin is debated among a great number of stakeholders, for instance member states versus the European Union in the European Court of Justice, food industry versus farming world and consumers, etc. The matter is of great legal complexity. Regulation n°1169/2011 on food labelling and the European Court of Justice case law set important limits on the power of member states to impose mandatory origin labelling. Furthermore, regulation n°1169/2011 provides that the origin of processed food products is based on the provisions of European customs law. In the US, origin requirements (COOL) are also an important issue. Lawyers have a major advisory role on all these crucial topics on which operators lacks expertise. A Case Study: Acquiring a Fully Leased Building from Due Diligence to Completion The 60th annual congress of the UIA will be dealing with compliance and data protection as the main themes. While in many respects compliance can be an intangible notion, it is apparent that it does affect every field of law ensuring that certain standards are met for business conduct and governance of firms. Often, in legal practice, a way to help your clients ensure compliance is to assist and advise in relation to their decision-making process so decisions are made in an orderly and informed fashion. In real estate acquisitions this will depend on a wide range of variables, such as the type of client (a mutual fund, a public entity, a listed PLC or even a private individual) and the type of property (investment portfolio, commercial or residential). In each case, a well-oriented due diligence process will be the key to ensuring compliance. Following the business practice approach started in our 59th annual congress, we would like to put the concepts of compliance and due diligence into a more practical context. We aim to have all speakers discuss a single case study that allows each to share the key cornerstones of the process of acquiring a fully leased property, from initial compliance formalities for new clients and exclusivity negotiations through to due diligence and completion. Alongside this we will try to identify what kind of issues can become a compliance problem for a particular type of client in each jurisdiction and share any specific examples and war stories from our own practice and experience. Interactions Between Immigration and Politics This session will discuss the interactions between immigration and politics, in particular in the light of recent events. The purpose of the discussion will notably analyse how legislation / policies of immigration / naturalisation in different jurisdictions have been recently affected by events that have been subject to intense political debates, such as economic downturn, terrorist attacks, refugee crisis, etc.

SUNDAY, OCTOBER 30, 2016 Recognition and Enforcement of Foreign Judgments and Foreign Arbitral Awards: Recent Trends and Developments Recognition and enforcement of decisions abroad are one of the most critical issues as regards dispute resolution in international matters. When the parties are based in different countries, it is essential for the creditor to obtain decisions easily and efficiently enforceable in those jurisdictions where the debtor’s assets are located. Sometimes the declaration of enforceability of a foreign decision (if required) is governed by international rules, but the way the national courts apply them can vary greatly. Moreover, when a foreign decision is enforceable, a further crucial point is the lack of uniform international legislation about enforcement procedures that remain entirely a matter of domestic laws of the country where enforcement is sought. These differences may result in length of enforcement procedures or even non-enforcement of decisions. This session will discuss recent worldwide developments regarding those issues both from a domestic and a crossborder perspective, with particular reference to the current trends concerning principles set forth on this subject in EU regulations and international conventions.

Specific situations causing harm in sports will be addressed such as injuries by and to athletes or spectators (e.g. injuries in collective sports such as football, incidents in stadiums, skiing accidents, etc.), including their consequences for athletes, clubs, sports associations, federations and other sports entities. A particular focus will be placed on how the courts deal with tortious actions in sports matters, in a comparative law perspective. Corporate Criminal Liability for Complicity in the Commission of Grave Crimes of International Law At a time when business enterprises are increasingly being accused of complicity in international crimes such as war crimes and crimes against humanity, international jurisdictions have yet to develop instruments that address the issue of corporate liability. Though models of corporate liability can be found in most domestic jurisdictions, those jurisdictions remain reluctant to prosecute their own nationals, whether – natural or legal persons. n Would the issue of corporate liability be better addressed in international forums? Does the complementarity principle work in practice? Should international courts take precedence? n Would there be no other option for the prosecution of such crimes before the ICC than a revision of the Rome Statute? What are the options before the ICC? n How would you advise your clients? Foreign Investment Dispute Resolution between Chinese and European Parties and the Advantages of Hong Kong as the Place of Arbitration Our session will focus on the resolution of investment disputes between Chinese and European parties, including the applicable law and procedure in Mainland China and Hong Kong, the types of disputes that commonly arise, including disputes arising from joint venture and shareholding agreements, commercial contracts, finance contracts and royalty agreements, when foreign law and a foreign place of arbitration for various types of investment disputes may be chosen under Mainland law, and the advantages of conducting arbitration of Sino/European investment disputes in Hong Kong. Case studies will be discussed. During this session, the law firms’ representatives will give a 3-minute presentation of themselves. The aim is to extend their network internationally for future engagements, to meet lawyers from around the world and to share their experience of managing law firms.

Budapest 2016 CONGRESS INFORMATION Assistance DURING THE CONGRESS

For any further information, UIA and Destination Plus representatives will be at your disposal at the Budapest Marriott Hotel to answer all your questions.

Shuttles / access

The UIA will not provide any transfer during daytime between the Budapest Marriott hotel and the other congress hotels which are all located a few minutes’ walk only. Transfers to and from your hotel will be provided for the evenings, except for the gala dinner. The shuttle schedules will be posted up in the congress hotels.

Accompanying persons

Members of the legal profession cannot be registered as accompanying persons for the congress. Accompanying persons are not authorized to attend the scientific sessions. To be able to participate in the social activities, accompanying persons need to have registered and paid the corresponding registration fees. They will be given a special badge.

Badge

The badge (congress participant or accompanying person) will have a bar code which your activities will be recorded on and which can be used as a pass. Please keep it with you at all times for access to sessions as well as luncheons and other social activities. Lunches

Lunches will be organised so that you have ample time to meet friends and colleagues. They will be served at the Intercontinental hotel which is a 5-minute walk from the Budapest Marriott Hotel. Access will be granted on presentation of your badge, and based on the selection you have made on your registration form.

GeNeRAL CONDITIONs All registrations received by the Union Internationale des Avocats (UIA) along with the full payment of fees corresponding to the events selected will be confirmed in writing. A registration number will be assigned to each participant, which will be required during registration at the Budapest Marriott Hotel for handing over the Congress documents. For any registration after September 30, 2016, payments must be made by credit card only (bank transfers will not be accepted after this date). The UIA and Destination Plus reserve the right to cancel or postpone the Congress to a later date, change the Congress venue and/or programme, make any corrections or modifications in the information published in the Congress programme and cancel any invitation to participate in the congress, at any time and at their discretion, without having to provide any reasons. Neither the UIA, Destination Plus, nor any of its managers, employees, agents, members or representatives shall be held responsible for any loss or damage, of any nature, suffered (directly or indirectly) by a Congress delegate, accompanying person or a third party following any cancellations, changes, postponements or modifications. Formalities

It is the responsibility of Congress participants to ensure compliance with police, customs and health formalities for their journey. Congress participants unable to take part in the Congress because of their inability to take a flight or any other means of transportation due to being unable to provide the documents required (passport, visa, vaccination certificate, etc.) cannot claim any reimbursement from the UIA.

force majeure

“Force majeure” means any event external to the parties, of both an unforeseeable and insurmountable nature, that prevents either the client or the participants, or the agency or service providers involved in organizing the Congress, from executing all or part of the obligations provided for in the present agreement. By express agreement, such will be the case in the event of a strike affecting the means of transport, hotel staff, air traffic controllers, an insurrection, a riot or any prohibition whatever decreed by Governmental or public authorities. It is expressly agreed that for the parties, a case of force majeure would suspend the execution of their reciprocal obligations. At the same time, each of the parties shall be responsible for all the expenses incumbent upon them, resulting from the case of force majeure.

Health

The organizers decline any liability in case of any health problems that may lead to complications or be aggravated during any part of the stay: pregnancy, cardio-vascular problems, any allergies, special diets, any disorders under treatment and not yet resolved on the day the Congress starts, psychological, mental or depressive illness, etc. (Non-exhaustive list).
