SB 465 (Hill) Amended that Would Require Contractors to Report Settlements Several months ago we discussed SB 465 (Hill) which was introduced in reaction to the June 16, 2015 tragedy when the balcony at the Library Gardens Apartments in Berkeley, CA collapsed, killing six students and injuring seven others. What convinced the author to carry the bill was the fact that notably, over the past three years, the company paid out $26.5 million dollars in construction defect settlements. According to the author, there is no provision in current law to require notification to the CSLB that these settlements had taken place; thus the board couldn’t perform their due diligence to ascertain if the settlements were due to shoddy workmanship or worse. To correct this oversight, the measure would have required all contractors to report any settlement of $25,000 or more to the CSLB in order for the board to determine if problems with the contractor existed that warranted a citation, suspension or revocation of the license. Unfortunately, since construction is highly litigious, it would have created lots of extra work for contractors, overburdened the CSLB staff and ultimately, not worked for the aforementioned reasons. Due to major opposition from the construction industry, which emanated during an informational hearing, the following amendments have been offered. While better, the bill still requires contractors to notify the CSLB on all settlements of an amount to be determined by the CSLB. Highlights of the amendments include: 1). Section 7021 is added to Business and Professions Code (a) By January 1, 2018, the board shall enter into an interagency agreement with the Division of Occupational Safety and Health to ensure that any citation, fine, or any other actions taken by the division against a licensed contractor, along with any other information the division may possess regarding a licensed contractor, is timely reported to the board. (b) By January 1, 2018, the board shall enter into an interagency agreement with any other state or local agency the board deems to be in possession of any information relevant to its priority to protect the public described in Section 7000.6. 2). Section 7071.18 is added to the Business and Professions Code: (a) Notwithstanding any other law, a licensee shall report to the registrar in writing the occurrence of any of the following within 90 days after the licensee obtains knowledge of the event: (1) The conviction of the licensee for any felony. (2) The conviction of the licensee for any other crime that is substantially related to the qualifications, functions, and duties of a licensed contractor. The bill passed yesterday 12-0 with 4 abstentions out of the Assembly policy committee and will be heard next in the Appropriations Committee. The University's primary objective in utilizing the design build approach is to bring the best available integrated design and construction experience to this project. The University has determined that proposers who submit proposals on this project must be prequalified. Prequalified proposers will be required to have the following California contractor's license: General Building Contractor, CSLB Licensing Classification B. In order to meet housing demand for new students and students with guaranteed housing in the near term, a temporary modular student housing project has been proposed for occupancy in Fall 2017. The initial program includes at least 350 – 600 beds in one, two, or three-story pre-fabricated modular housing units for second-year students located on the campus. Two sites have been identified: the first is an open meadow grassland adjacent to a recreational facility. The second is a wooded forest in the northwest corner of the campus adjacent to the North Remote Parking Lot. Both sites are approximately 150,000 sf. The scope of the project includes developing the appropriate scales of community to support undergraduate housing. Units are anticipated to include single and/ or double rooms with a small kitchenette, living space and bathrooms. Modular unit clusters would be supported by a laundry facility with multipurpose community space and a communal kitchen. Pedestrian connections and improved transit options to strengthen links to the academic core will also be considered. A parallel project will be providing new infrastructure and utilities to each site; the design-build team will assume a single point of connection for all infrastructure and utility work within the site boundary. Safety Tip of the Week DRINKING & DRUGS - NOT ON THE JOB All of us know that certain drugs are illegal, and that drinking or drug use can lead to both physical and mental impairment, and also that state and federal laws prohibit or regulate the use of drugs and alcohol. Catchy phrases such as 'Drinking and driving don't mix', ‘Just say no to drugs', 'MADD, Mothers against drunk driving' and 'D.A.R.E. to keep kids away from drugs' serve as reminders and warnings of the dangers associated with drug abuse and the irresponsible use of alcohol. We also need to be concerned about those who use these substances on the job. The nature of our work demands total concentration on what we are doing. One slip could cause a serious injury or even death -- and the victim could be you or a co-worker. Certainly the jobsite is no place for anyone using drugs or alcohol. Construction activities require employee alertness -to constant changes on the site and the ability to follow safe work practices to prevent accidents. Experts suggest that 14% of workers use some type of substance on the job, and that 50% of those users try to sell drugs to other employees. Drug and alcohol users are more prone to have accidents, reduced productivity, increased tardiness and absenteeism, and poor quality work. It is up to you to avoid becoming a statistic, and to make your workplace safe and productive.
