Bar Association Regulations (The Laws of the State of Israel and Practical Examinations Procedures), 5723-19621 By virtue of the powers vested in me pursuant to Sections 110, 26(2) and 39 of the Bar Association Law, 5721,1961, I hereby enact these regulations: Chapter One: The Laws of the State of Israel Bar Examinations 1. Laws of the State of Israel Examination Dates (Amendment: 5749) (a) The laws of the State of Israel Bar examinations (hereinafter – the Examinations) will be held on behalf of the Bar at least twice a year on dates to be determined. (b) Notices pertaining to the examination dates, venue and languages that they will be held in will be promulgated in the Reshumot (Official Gazette). 2. Proving the Right to Sit the Examination A person seeking to sit the examinations will attach to the application pursuant to Section 4 of the Bar Association Rules (Knowledge of the Hebrew Language and Hebrew, Laws of the State of Israel and Practical Examination Fees), 5722-1962, documents proving that he has satisfied the conditions stated in Section 25(2) or (3) of the Law. 3. Written or Oral Examinations (Amendment: 5749) (a) The examinations will be in writing, however the Bar may, under special circumstances, permit an examinee, per his request, to sit some or all of the examinations orally. (b) A written examination will be for 3 hours. (c) The examinations will be in Hebrew, however the Bar may permit an examinee or a class of examinees to answer the questions in a foreign language, provided that the examinee bears the costs of translating them into Hebrew as will be determined by the Bar. (d) The Bar may determine that examinations on a certain date or venue will be in a foreign language. (e) Whoever proved knowledge proficiency in the Hebrew language, as required to register as an intern, in accordance with Section 2 of the Bar Association Rules (Knowledge of the Hebrew Language and Hebrew, Laws of the State of Israel and Practical Examination Fees), 5722-1962, will not be permitted to sit the examination in a foreign language. 4. Examination Topics (Amendment: 5734, 5759) (a) The examinations will be on the following topics: (1) Obligations Laws and Labor Laws and Social Insurance; (2) Property Laws; (3) Family and Succession Law; (4) Criminal Law and Criminal Procedure; (5) Commercial Law A (Corporate); (6) Commercial Law B (Bankruptcy, Liquidation, Bills of Exchange, Taxes and Other Commercials Topics); (7) Civil Procedural Law and Professional Ethics; (8) Constitutional and Administrative Law.

(b) The laws that the examinees will be examined on will be as detailed in the Addendum and as drafted 30 days before the examination, unless if canceled beforehand. 5. Each Examination Will Test at Least Two Topics (a) An examinee may, on one date, sit all the topics determined in Regulation 4 or on another date, and some on other dates, provided that on each date the examinee is tested on at least two topics so long as he has more than one topic left. (b) Notwithstanding the foregoing in sub-regulation (a), the Bar may permit the examinee to test on one date only one topic if it deemed it correct to do so due to the examinee called for military service. 6. Exemption (Amendment: 5729) (a) The Bar may exempt a law school graduate of a foreign institution who has satisfied the conditions in Section 25(2) of the Law from an examination on a specific topic if it is of the opinion that the person satisfied the conditions in an examination at such an institution were on topics similar to the laws of the State of Israel. (b) The Bar may, at its discretion, exempt a person who has satisfied the conditions in Section 25(3) of the Law, from an examination on a specific topic, if it was of the opinion that the laws in the country in which that person served in one of the roles referenced in that section are similar to the laws of the State of Israel. (c) The Bar may, at its discretion, exempt a person from an examination on a specific topic if he has satisfied the conditions stated in Section 103A of the Law. 7. Examiners and Supervisors (a) The Bar will appoint examiners and supervisors for the examinations in general or for examinations on a specific date or examinations on a specific topic; the Bar may pay them a fee as determined. (b) An examinee must comply with the supervisor of the examination instructions. 8. Examination Practice (a) A number will be determined for each examinee and the examinee will write his number and the topic of examination on the notebook; the examinee will not write his name on the notebook. (b) If the examinee uses several notebooks, he will write the foregoing information as stated in sub-regulation (a) on each one and will affix them to the first notebook after having noted the serial numbers on the notebooks. (c) An examinee will write his answers on one side of the page. (d) The examinee will not tear pages out of the examination notebook. 9. Use of Books (a) The Bar may permit examinees during the examination to use a book containing the draft of the legislation. (b) If such use of a book is permitted, the examinee will not use any other book or list or writing that contains meanings, comments or other notes other than the draft of the legislation itself.

10. Discipline An examinee who has in his possession a book, list or writing beside him during an examination and the use of such is prohibited pursuant to Regulation 9, or he disturbs or helps another examinee, or does not adhere to the supervisor's instructions, the supervisor may, if he has grounds to assume that the examinee did the foregoing, stop his examination and remove him from the examination room. 11. A Disciplinary Violation (a) An examinee who violated the disciplinary rule as stated in Regulation 10, whether his examination was stopped and he was removed from the examination room or if his examination was not stopped nor was removed, the Bar may prohibit him from participating in the examination on another date, whether only in relation to the same topic or other topics, if in general or for a certain time; it may also disqualify any examination he has already sat. (b) The Bar will not reach a decision as stated pursuant to sub-regulation (a) until after it has given the examinee an opportunity to plead his case to it or before a committee appointed to do so. 12. Examination Results (a) The examination results will be subject to the examiner's discretion and will be noted in percentages not to exceed 100. (b) If examinations were conducted orally by two examiners jointly and their opinions differed, the more lenient opinion will be followed. (c) The Bar will inform the examinee of his results after they are received from the examiner. 13. Failing an Examination (a) Whoever received less than 61 percent in an examination he sat will be considered to have failed the examination. (b) An examinee who failed an exam may retake the examination on one of the dates determined in Regulation 1. (c) If the examinee received more than 45 percent, the Bar may, at his request, determine that he retake the examination on an earlier date than that stated in Regulation 1. 14. Confirmation of Examination Results An examinee who passed the examinations in each topic determined in Regulation 4 or those that he was not exempted from taking, is entitled to receive confirmation thereof from the Bar. Chapter Two:

Practical Bar Examinations

15. Examination Date (Amendment: 5746, 5755, 5756)2 The practical Bar examinations will be held twice a year, on the dates determined by the Bar. 15A. Special Examination Date (Amendment: 5756) 2

Notwithstanding the foregoing in Regulation 15, the Minister of Justice upon consulting with the National Council of the Bar Association, may determine an additional date to take the practical examinations due to special reasons to be recorded in his decision. 15B. The Bar Will Determine two dates each year upon which oral examinations will be held; these dates will be in addition to the dates determined pursuant to Regulation 15. 16. Applying to Take the Examination (a) The application to take the practical Bar examinations (hereinafter – The Internship Examinations) pursuant to Section 4 of the Bar Association Rules (Knowledge of the Hebrew Language and Hebrew, Laws of the State of Israel and Practical Examination Fees), 5722-1962, will be submitted at least fifteen days prior to the examination date. (b) Documents proving the applicant's right to take the internship examinations will be attached to the application; confirmation from the Bar that the candidate completed his internship period will be decisive evidence in this respect. 17. Examination Boards The examination boards as stated in Section 40 of the Law will be comprised by the Bar in general or for a specific examination. 18. Examination Topics (Amendment: 5729, 5740, 5745, 5751, 5758, 5763) The internship examination will be oral; however, the Bar may determine that the internship examination will be, in its entirety or in part, in writing in addition or instead of the oral examination. The examinee will be tested on several of these topics: (1) Basic Laws; (2) The Courts powers, including but not limited to Rabbinical Courts and Labor Courts; (3) Criminal Procedural Law including but not limited to investigation and enforcement powers and civil procedures including but not limited to arbitration; (4) Laws of evidence, emphasis put on the practical aspect; (5) Execution, bankruptcy and receivership proceedings; (6) Land registration and rights to land procedures as well as tax principles associated thereto; (7) Registering corporations, incorporation documents, winding-up process, recording charges and canceling them; (8) Drafting contracts and legal documents; (9) Changes and innovations in legislation and case law in the areas appearing in this Regulation; (10) Professional Ethics, Bar Association Law, 5721-1961, and rules enacted by virtue thereof; (11) General knowledge of interpretative rules. 18A. Examination Format (Amendment: 5758)

The practical examinations will be comprised of a written examination and an oral examination; an examinee may only take the oral examination if he passes the written examination. 18B. The Written Examination (Amendment: 5758) (a) The written examination will be based on a multiple-choice questionnaire to be prepared by the Examination Board (hereinafter – the Questionnaire) in which the examinee will choose one answer of the different options given to him, as the correct answer. (b) The Examination Board will determine the topics of group of topics to be included in the questionnaire from the topics detailed in Regulation 18; the questionnaire will be split into sections, whereby each one of them will concentrate all the questions on a topic or several topics determined by the Board as stated above. (c) In addition to the questionnaire the Examination Board may include in the written examination also a legal document drafting section; no score will be given in relation to the legal documents drafted by the examinee within the framework of the written examination. 18C. Written Examination Results (Amendment: 5758) Whoever obtained at least a score of 60 percent in each of the sections of the questionnaire will be deemed to have passed the written examination; however if a score obtained in one or more sections of the questionnaire was less than 60 percent, will be deemed to have passed the examination only if his overall score was at least 65 percent. 18D. An Examinee with Disabilities (Amendment: 5760) (a) In relation to the written examination pursuant to Regulation 18B, the Examination Board may, at the examinee's request, who is a person with disabilities within the meaning of the phrase in the Equal Rights for People with Disabilities Law, 5758-1998, make certain adjustments that are required due to the disability which will guarantee that he be examined based on equal conditions insofar as possible to the examinees. (b) Adjustments that are made by the Examination Board as stated in subregulation (a) may include an examination format that differs from that stated in Regulation 18B (a). 19. Remitting Information to the Examination Board (Amendment: 5758) The Bar will remit the examinee's instructors reports, the written examination results and the legal documents drafted by the examinee within the framework of the written examination to the Examination Board. 20. Oral Examination Results (Amendment: 5758) (a) At the end of the oral examination, the Examination Board will determine whether the examinee has passed or failed and this based on its impression of the examinee's oral answers, his instructors reports, the legal documents drafted by him and upon considering the results of the written examination. (b) The Chairman of the Examination Board will inform the examinee of the examination results, will record the results in the examinee's personal file and will confirm them by his signature.

21. Retaking the Examinations (Amendment: 5758) (a) An examinee who failed the written examination may retake it on the dates determined pursuant to Regulation 15 or 15A. (b) An examinee who failed the oral examination may retake it on the dates determined to do so pursuant to Regulation 15, 15A or 15B; however, an examinee may retake the examination only on two of three consecutive examination dates. 22. Confirming the Results of the Internship Examination An examinee that passed the internship examination is entitled to receive confirmation thereof from the Bar. Chapter Three: Miscellaneous Provisions 23. Repeal Repealed – (1) Regulations 2 through 4, 7 through 11, 13, 35 through 37, 59 and 40 of the Legal Council Regulations, 5713-1953. (2) The addendum to the said Regulations as replaced in the notice concerning amending the Addendum pursuant to Regulation 7(d).
