CALL TO ORDER AND CERTIFICATION OF A QUORUM: Invocation and Pledge of Allegiance Mayor Masters called the meeting to order at 7:00 p.m. Pastor Percy Powell with New God’s Household of Faith Church gave the Invocation, and Mayor Pro-Tem Walter Wilson led the Pledge of Allegiance. City Secretary Carolyn Anderson called roll and certified a quorum. Council Members present were as follows: Mayor Julie Masters, Mayor Pro Tem Walter Wilson and Council Members Charles Suderman, Mary Dunbaugh, Mark Townsend, Louis Decker and William King. Also present were City Administrator Julie Johnston, City Attorney Loren Smith, Chief Building Official Kevin Byal, Management Assistant Jessica Rogers, Public Works Director Kellis George, Police Chief Ron Morales, and Finance Consultant Walter Thomas.

Welcome Boy Scout Troop 696 Welcome and thanks to all for coming Bayou Breeze Keep Dickinson Beautiful article Thanks to the 315 volunteers who came out to help with Trash Bash 75 to 80 percent were kids under 18 28,000 pounds of debris and trash, 204 tires and 225 pounds of glass and plastics collected for recycling the day of Trash Bash Drive For Your School benefiting the Dickinson ISD Education Foundation will be held on Friday, April 12, 2013 from 10:00 am – 5:00 pm. Drive a McRee car. TML Region 14 meeting – Mayor Pro-Tem of Pearland is the current President. The focus of the meeting was addressing education and awareness of youth in city government through Youth Action Councils. Councilman King would like to conduct a workshop on Youth Action Councils at a future Council meeting to gain additional information and possible interest in the program. Mt. Carmel food distribution at Mt. Carmel Baptist Church with 250 families attending Clean-up of the Magnolia Cemetery on Saturday, April 13, 2013 from 8:00 am to 12:00 pm May 15th National Police Officers Ceremony April 24th – National Crime Victims Week

NCMA – small business conference dealing with NASA and prime contractors Friends of Library book sale on Saturday, April 13, 2013 from 10:00 am – 1:00 pm April 18th – Local Photographer Peter Bowman will be the featured local artist at Dickinson Public Library on Thursday, April 18th. April 25th Dickinson Historical Society – 4th Thursday of the month Senior Social at 10:00 a.m. April 26th – Dickinson Historical Society Annual Wine and Roses fundraiser at KC Hall at 7:00 pm Keep Dickinson Beautiful, a non-profit organization, was formed at the request of a former mayor over 25 years ago. Councilwoman Dunbaugh requested an item on the next agenda for permission to display Keep Dickinson Beautiful plaques and awards at City Hall Festival of Lights – still negotiating with County regarding Paul Hopkins Park DCPAAA Police Academy Hosting Region I meeting Saturday, April 13, 2013 May 3rd – 5:30 – 7:30 Fish Fry at KC Hall Thanks for community support for Knights of Columbus Fish Frys during Lent Red White & Bayou Crawfish and Texas Music Festival on Saturday, May 18th from 11:00 am to 11:00 pm

Public Works Director Kellis George presented Council with an update on Items A through F. Item G: Following discussions with Councilman Townsend after the last Council meeting, City Administrator Julie Johnston asked for further direction from Council regarding the location of the signage on Bramble Lane. Public Works Director Kellis George presented Council with an update of the traffic study and the placement of the signage as directed by the Council during the April 9, 2013 meeting. Following a discussion among Council and recommendations from Chief Ron Morales, it was the consensus of Council to move the “Dead End” sign back to where it was originally and to utilize a double-sided sign with an arrow that would be visible when driving either direction on Owens Drive. Additionally, it was the consensus of the Council to keep the “Children at Play” and speed limit sign on the pole where it is currently. ITEM 6.)

CONSIDERATION AND POSSIBLE ACTION CONCERNING: Update on Hurricane Ike CDBG Grant Projects A. Required Outreach for Section 3 Program Management Assistant Jessica Rogers presented Council with an update on the required outreach for the Section 3 Program.

CONSIDERATION AND POSSIBLE ACTION CONCERNING: Ordinance Number 757-2013 AN ORDINANCE OF THE CITY OF DICKINSON, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY, ORDINANCE NUMBER 420-2001, AS HERETOFORE AMENDED, TO GRANT A SPECIFIC USE PERMIT NUMBER SUP-130186 SO AS TO ALLOW THE USE OF CHURCH AND RELIGIOUS SERVICES ON ± 0.215 ACRES, LEGALLY DESCRIBED AS ABST 19, PERRY & AUSTIN LOT 10 O-L 187 TERMINI S-D HIGHWAY 3 DICKINSON, MORE COMMONLY KNOWN AS 2512 TERMINI STREET, GENERALLY LOCATED SOUTH OF TERMINI STREET AND WEST OF NEVADA STREET IN THE CITY OF DICKINSON, GALVESTON COUNTY, TEXAS, PRESENTLY ZONED GENERAL COMMERCIAL; DIRECTING A CHANGE ACCORDINGLY IN THE OFFICIAL ZONING MAP OF THE CITY; PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION HEREOF; AND PROVIDING A REPEALER CLAUSE, A SAVINGS CLAUSE, A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE. PUBLIC HEARING: Convene A Public Hearing Regarding A Request For A Specific Use Permit On Approximately 3.7424 Acres For A “Flea Market” In The General Commercial (GC) Zoning District, Legally Described As ABST 78 ROBT HALL Lot 7 & 8 & All Of Lots 9 & 10 Tudor Addition Except Strip Off S End For FM 517, Generally Located North Of FM 517 East And West Of Baker Drive With The Address Being 5205 FM 517 East. Mayor Masters convened the Public Hearing at 7:56 p.m. A.

Applicant’s Statement Building Official Kevin Byal presented Council with an overview of the request for the Specific Use Permit. Mr. Byal stated that Planning & Zoning Commission had recommended denial of the Specific Use Permit. Paul Robinson, 4600 Country Club Drive, Dickinson, Texas, presented the proposed concept of an open-air flea market to the Council on behalf of the Applicant.

Those Against James Boyd – 5520 Thistle Drive, Dickinson, Texas Spoke on behalf of the members of Baker Drive Baptist Church opposing the negative impact from the crowds, noise and traffic increase, creating a negative impact on the church Pastor Stephen McGehee – 3904 Baker Drive, Dickinson, Texas Pastor of Baker Drive Baptist Church spoke to the negative impact to the school and the surrounding neighborhood and the increase in traffic at FM 517 and Baker Drive. Pastor McGehee also spoke to the requirement for a permanent structure. Shirley Scott – 5104 39th St., Dickinson, Texas Ms. Scott shared her concerns regarding the temporary structures, FEMA and the negative impact to the area.

ITEM 10.) CONSIDERATION AND POSSIBLE ACTION CONCERNING: Presentation and Acceptance of Fiscal Year 2011-2012 Audited Comprehensive Annual Financial Report and Federal Single Audit Report Prepared By Belt, Harris Pechacek, LLLP, Certified Public Accountants. Finance Consultant Walter Thomas presented the Fiscal Year 2011-2012 Audited Comprehensive Annual Financial Report and Federal Single Audit Report. Mr. Thomas recommended acceptance of the report. Mr. Robert Belt of Belt Harris, Pechacek, LLP was also present.

Councilwoman Dunbaugh made a motion to accept the audit. Councilman King seconded the motion. Mayor Masters thanked the auditors and Mr. Thomas for their work on the audit. There being no further discussion, Mayor Masters called for the vote. VOTE: 5 AYES (Suderman, Dunbaugh, Wilson, Decker and King) 0 NAYS ITEM 11.) DISCUSSION AND DIRECTION CONCERNING: Process and Schedule for Adopting Budget Amendments and Recommendation by Auditors To Pass Budget Amendments At Year End. City Administrator Julie Johnston presented Council with the history of the process for adopting budget amendments. Finance Consultant Walter Thomas presented the change to the budget amendment process suggested by Belt Harris, Pechacek, LLP. City Administrator Julie Johnston shared that numbers are currently being tracked very closely. Following a brief discussion and clarification by City Attorney Loren Smith, it was the consensus of Council: (1) to continue the Council’s process of adopting midyear budget amendments, (2) not to do an end of fiscal year budget amendment as suggested by the auditors, and (3) to allow the City Administrator to determine if an additional budget amendment at the end of a fiscal year is necessary and, if so, to bring such additional budget amendment forward to Council. ITEM 12.) DISCUSSION AND DIRECTION CONCERNING: Purchase and Installation of GPS Tracking Equipment on All City Vehicles. City Administrator Julie Johnston advised that this item had been placed on the agenda at the request of Councilman Suderman. Ms. Johnston presented Council with the background and projected fees and recurring costs for placing GPS on approximately 48 vehicles or City equipment that do not currently have GPS devices. A discussion by Council followed regarding possible options and clarification. Chief Ron Morales addressed Council regarding Police Department vehicles. Councilman Suderman clarified that his request was not for all vehicles, but for specific take-home vehicles. There being no further discussion, Councilman Suderman requested that the City Administrator research the costs to place GPS in all take-home vehicles excluding Police Department CID vehicles and any other PD vehicles used for other than marked purposes. Councilman Suderman also requested a copy of the policy adopted by the Council concerning take-home vehicles. ITEM 13.) DISCUSSION AND DIRECTION CONCERNING: Possible Ordinance Banning Texting and Driving In The City Of Dickinson.

Mayor Masters shared that the ‘It Can Wait” texting item was placed on the agenda at the request of Dickinson citizen Darrel Dudley. Following a discussion and clarification by City Attorney Loren Smith and Chief Ron Morales, it was the consensus of Council for the City Administrator to bring forward an ordinance banning texting while driving if the legislation being considered at the State level fails. ITEM 14.) EXECUTIVE SESSION: The City Council will now hold a closed executive meeting pursuant to the provision of Chapter 551, Government Code, Vernon’s Texas Codes annotated, in accordance with the authority contained in: Mayor Masters recessed the meeting into Executive Session at 9:15 p.m. A. Section 551.071 – Consultation with Attorney regarding pending or contemplated litigation or a matter in which the duty of the City Attorney requires to be discussed in closed meeting. ITEM 15.)
