Application Form & Guidelines For Residential Tenancies

To proceed with an application the following supporting documentation is required to be attached with a tenancy application:

TENANCY APPLICATION GUIDELINES 1. A property will not be reserved to any applicant unless a completed application form and the administration fee have already been received. Please ensure that the application form is completed in full as failure to do so may delay the processing of an application. 2. Application forms will only be processed when accompanied by the administration fee. 3. When an application has been received by Hicks Hadley it will be forwarded to a referencing agency for the purposes of undertaking references from an employer and/or any current Landlord. The referencing agency will also carry out a full credit check for adverse credit. 4. Hicks Hadley attempt to avoid having several potential applicants applying for the same property. If a property is already under application, any potential applicant(s) will be notified and will be entitled to leave a completed application form, should the existing application fail. In addition, any applicants should also continue their search and view other properties currently available with Hicks Hadley in such an instance. 5. An application fee is required for each person over the age of eighteen who is to be living at the property. A non refundable application fee of £125.00 + VAT is required for the first adult and £100.00 + VAT for each subsequent adult. The property will cease to be marketed (subject to deadlines for newspapers and portal feeds etc.). Forms are to be completed and returned to Hicks Hadley within 3 days together with all supporting documents. Applications can be only be progressed once all documentation has been received. 6. In addition to this paper application, applicants will be expected to complete a digital form which will be sent via email to them upon receipt of the application fee. 7. Successful applicants are to sign an Assured Shorthold Tenancy Agreement and standing order mandate for rent payments on the day of handover. Handovers are carried out at our Halesowen Branch where any successful applicant(s) is/are to sign for keys to the property. 8. On the day of the handover successful applicants will be asked to pay a deposit, which is normally equal to one and a half months rent (when the applicant has pets it is normal to pay two months rent as a deposit), together with the first month’s rent, which is payable in advance. Rent is always payable in advance throughout the term. These payments are to be made in cleared funds, such as Bankers Draft/Building Society Cheque. Other payment terms may be permitted (Personal and company cheques are not accepted unless they have cleared before the commencement of the tenancy). 9. An administration fee of £15.00 + VAT is to be charged for the acceptance of cash on handover, £5.00 + VAT for debit cards and 3.50% charge for credit cards, upon the handover of a property. 10. The deposit will be held in a recognised scheme, such as the Tenancy Deposit Scheme, The Deposit Protection Service or similar. Successful applicants will be notified, upon handover of the location of any such deposit. Deposits taken will be returned at the conclusion of the tenancy providing there is no breach of contract and there are no dilapidations. The property is to be returned to the landlord in the same condition in which it was let. 11. All properties are let as seen and will be available for a period of no less than six months. 12. If an applicant requires a guarantor (who must be a family member who owns their own home and be in full time employment), a Guarantors Form must be completed and returned to Hicks Hadley with all supporting documentation. An additional fee of £62.50 + VAT is required. The Guarantor must prove their income substantial enough to cover the rent of any prospective applicant. The Guarantor must also attend at the handover to sign the relevant documentation to support any Applicants tenancy. If it is not possible, Hicks Hadley are to be advised in advance, where it is sometimes possible to make alternative arrangements. Failure to comply with this may result in an application being refused and not permitted to collect keys on handover.

I hereby acknowledge at the commencement of the tenancy in addition to one months rent in advance, a security deposit will be required which is normally an amount equal to one and a half months rent (an amount equal to two months rent when an applicant has pets.) which will be returnable at the termination of the tenancy, subject to all tenancy covenant being fulfilled and no dilapidations upon conclusion of the tenancy. This payment must be paid by means of a Bankers Draft/Building Society cheque or cleared funds. PERSONAL OR COMPANY CHEQUES WILL NOT BE ACCEPTED UNLESS 10 DAYS IS ALLOWED FOR CLEARANCE PRIOR TO THE START OF THE TENANCY. I will be asked to sign a standing order mandate for the remaining rental payments and that keys to the property will not be released to me until this has been done. I also agree that the deposit paid will not be used to set off the payment of the rent for the final month of the tenancy. I hereby declare to the best of my knowledge that all my answers are true and correct and I agree that the above statement shall form part of the agreement.

TENANTS OBLIGATIONS 1. All correspondence, which is not addressed to the tenant personally, should be redirected to the Lettings Office at Hicks Hadley (Halesowen Branch) immediately as there may be a letter that requires urgent attention. There is no postage payable on re-addresses unopened mail. 2. During the period from November to March inclusive, there is always danger of damage to the property resulting from cold weather and burst pies etc. Should the tenants be away from the property at any time, but particularly during these periods it is the tenants responsibility to ensure that some form of heating is left low or other action taken to prevent damage occurring. 3. To always contact the Letting Office or Landlord (where applicable) if any queries arise regarding repairs to the property or any appliance in it before arranging for any work to be undertaken unless it is out of hours and considered to be an emergency. Any damage caused to the property by failure to report repairs within a reasonable timescale will be the responsibility of the tenant. 4. Breakages of windows or glass doors are the tenants responsibility for repair unless caused by vandalism or burglary, in which case, a crime reference number must be obtained from the police to enable the Landlord to claim on his buildings insurance. 5. Upon vacation of the property all furniture and items listed on the inventory must be put back into the locations indicated on the inventory. Failure to do so will result in charges of £25.00 + VAT per hour for a representative to return them to the relevant rooms. 6. The tenant is asked to note that when their Tenancy Agreement (or any endorsement made thereafter) and the said agreement states a specific length of tenancy, they are legally bound to pay rent for the full term of their tenancy, whether or not they are to remain at the property for that length of time. 7. Upon vacating the property the tenant should arrange with the post office for all mail to be re-directed to their forwarding address, neither the landlord nor his Agent will be responsible for the re-direction of tenants mail. Should the tenant require access to the property to retrieve any mail after the conclusion of a tenancy, the Agent would make a charge of £15.00 + VAT per visit. 8. The deposit is held in respect of damage to the property and such deposit to be returnable at the end of the tenancy subject to any deduction for breach of tenancy, or damage to the property or in compensation for the breach of any other terms in the Agreement. 9. Any television sets which may be included on the inventory at the commencement of the tenancy may be used by the tenant, subject to repairing the television if, as and when required and the tenant accepts the full responsibility of paying any associated licence fee for the use of such (where applicable). 10. At no time keep pets including a dog, a cat or reptiles in or about the property without written permission from the Landlord or his Agent.

11. The tenant may not remove or store furniture or items belonging to the Landlord without permission in writing from the Landlord or his Agent and then this will only be permitted providing the items are suitably insured, at the expense of the tenant. Any items removed must be returned by the conclusion of the tenancy (refer to clause 5) 12. To permit the Landlord or his Agent at a reasonable hour, within the last 28 days of the tenancy to enter and view the property with prospective Tenant or Purchasers. 13. To keep the interior of the premises in good decorative condition and repair. Not without written permission from the Landlord or his Agent make any structural alterations or redecoration, or remove any partition, door, cupboard, fixture or fitting. 14. To keep the garden in a proper state of cultivation and clear from weeds and rubbish or as it was at the commencement of the tenancy. 15. No television/satellite dishes/receiver to be installed or erected at the property without written permission of the Landlord or his Agent, and at the end of the tenancy make good any damage to the structure or brickwork. 16. The tenant hereby agrees to comply with the provision of the Tenants Obligation issued by the Landlords Agents receipt of a copy of which is hereby acknowledged. 17. To pay rental to the landlord or his Agent by standing order directly on a monthly basis to reach the Landlord or his Agent no later than the rent due date. Failure to make payments on time will result in a £25.00 + VAT charge for each letter issued and £5.00 + VAT for each telephone call made relating specifically to the late or non payment of rent. 18. Cash payments for rent will only be accepted at our office by prior arrangement and will incur a £15.00 + VAT administrative charge. 19. If the tenant(s) remain in possession after the expiry of the term and no new tenancy comes into being, the tenant(s) becomes entitled to a statutory periodic tenancy which the tenants can bring to an end by serving on the Landlord or his Agent not less than one calendar month notice of the intention to quit, which must be given in writing and served on or before the rent due date and advising the date of intending departure. 20. To be responsible for notifying your bank to cancel the standing order for rental payments at the end of the tenancy but only AFTER the final rental payment has been made, failure to do so will result in a £15.00 + VAT administrative fee. 21. In the case of sharers being jointly or severally liable for the rental payments and note that any notice served is for and on behalf of all parties.
