All LifeMiles members shall be subject to the following terms and conditions of the program •

Avianca and TACA reserves the right to modify, amend or replace the terms and conditions, regulations, special ofers and benefts of the LifeMiles program at any time and at its sole discretion, with or without notice. This means that the accumulation of miles by members does not give any vested right in respect of those miles, awards or program benefts. Members cannot assume the continued availability of any benefts or level of benefts in the program and members may or may not have access to all the benefts or seat availability on all fights. Any beneft, including award tickets may be subject to increases in mileage requirements or new restrictions at any time. Avianca and TACA may at any time, among other things, (i) withdraw, limit, modify or cancel any benefts, including award tickets, (ii) change program benefts, mileage levels, participation of allies, conditions of participation, rules for accumulation and redemption of miles, rules for use of the benefts and validity of the miles, (iii) establish date limits on tickets, limit the number of seats available for award tickets (including but not limited to the exclusion of seat availability on certain fights), or at least restrict the availability of the benefts or special ofers. Avianca and TACA may make these changes at any time, even though such changes may afect a member’s ability to use the miles already accumulated. Avianca and TACA reserves the right to terminate the program by giving six (6) months notice. The termination of the program, and / or changes, amendments or modifcations to the terms and conditions of the program will not give rise to any claim or compensation from any member or third parties.



An up to date version of the program’s terms and conditions will be always be available on www.LifeMiles.com, or it may also be requested from any Avianca or TACA customer service center. It is the duty and responsibility of all program members to know, comply with and keep up to date with all rules and policies of the LifeMiles program, any additional information for members, news and the status of their account through www.LifeMiles.com, or any Avianca or TACA customer service center in order to understand the rights, responsibilities and the status of their membership under the LifeMiles partner program. All program regulations may be modifed, amended and / or replaced in whole or in part at any time by Avianca and TACA.



Any activity in a member’s account extends the life of the miles in that account for a period of twenty-four (24) months from the date of the last activity. Activity shall mean any transaction, either accumulation or redemption, that afects the member’s miles balance.



Accumulated miles have no cash value of any kind and under no circumstances is it permitted to buy, sell, exchange or transfer miles, except where that transaction is authorized by the LifeMiles program according to its terms and conditions. It is also not permitted to buy, sell, exchange or transfer any award, including but not limited to LifeMiles program award tickets, for any personal gain or that of third parties. Miles, benefts or awards, including but not limited to award tickets, will not be valid if transferred in exchange for cash or any other form of consideration or remuneration. Members who engage in any of these practices (and any person using any beneft or award ticket obtained in this way) shall be responsible for paying the full amount associated with the damages and / or loss incurred by Avianca and TACA, as well as legal and operational costs caused by this practice.



In accordance with government regulations applicable in each country, the sale of miles and the issue of award tickets purchased through miles in any country where LifeMiles operates may be subject to local taxes or other charges required by the country where the transaction takes place. All taxes, fees and other charges to be paid for the use of an award ticket purchased through miles are the sole responsibility of the member conducting the transaction.



The LifeMiles program has diferent membership levels that the member can access according to the requirements established by the program for each level. All information regarding membership levels can be obtained from https://www.lifemiles.com/eng/abo/wnb/wnbelitab.aspx



Joining and continued membership of the LifeMiles program requires that the member comply with all Avianca and TACA terms and conditions, as well as those of other airlines afliated with the program, and the procedures established by the relevant authorities.



These terms and conditions, as well as the LifeMiles program benefts (including miles), are not negotiable or redeemable for cash or any other beneft or consideration not authorized by Avianca or TACA.



Except where specifed herein, these terms and conditions do not apply to other Avianca or TACA programs, or any of their afliates or subsidiaries, or any other airline, entity or company.



The accumulation of miles, as well as the miles balance in a member’s account, is personal and nontransferable except where authorized by these terms and conditions, and cannot therefore be inherited, nor may they be combined with the miles balance of another program member. The miles balance in a member’s account, as well as benefts including but not limited to award tickets, are not part of the member’s equity. The miles balance in the member's account, the benefts and award tickets, are all non transferable (i) upon death of the member, (ii) for reasons of family relationship, (iii) through law, or (iv) for any other reason.



The purchase of miles in the program and the transfer of miles between accounts is allowed only when and how LifeMiles indicates, detailing the terms and conditions of such transactions to which the members must adhere and which may establish, among other things, restrictions on the amount of miles that can be bought or transferred, as well as establishing the collection of an administration fee which should paid by the member when conducting such transactions. All taxes and fees generated by such transactions according to the applicable legislation will be the responsibility of the member carrying out those transactions.



Anybody over the age of two (2) years is eligible for membership of the LifeMiles program. Legal and other entities are not eligible for program membership and cannot earn miles, except as provided in these terms and conditions.



Currently membership of the program is free and without any cost to the member, however, Avianca and TACA reserve the right to establish a membership charge for the program at any time and at their sole discretion.



Membership of the program is personal and not transferable, and one account may be associated with only one person. Interested parties can register through the website www.LifeMiles.com, or through any Avianca or TACA customer service center, and must provide their full name, email address and / or home address, and any other information requested by LifeMiles as a requirement for enrollment. Upon acceptance into the program, the person becomes a member of the LifeMiles program and accepts its Terms and Conditions. The LifeMiles program reserves the right to refuse the registration of persons who do not meet the requirements to participate in the program. Program members may not maintain more than one LifeMiles account. In the event that more than one account is assigned to the same person, the duplicate account will be canceled by LifeMiles and only the balance of miles will be transferred from the said account, excluding any balance obtained from enrolling in the program.



For all members requesting a LifeMiles program membership card it will be issued with their full name and account number, which will be sent together with a copy of the terms and conditions of the program, only to the home address indicated in the account and subject to any other administrative charge Avianca and TACA deems appropriate, which shall be communicated to the member when the card is requested. Members may request their membership card from some Avianca or TACA customer service centers. The Avianca and TACA centers that can provide this service will be listed on the www.LifeMiles.com website. The membership card is owned by Avianca and TACA, and must be surrendered upon request.



Upon enrollment in the LifeMiles program, a new unique account number will be assigned to the member which is non-transferable and is called the “LifeMiles number”, “frequent fyer number”, “identifcation number” or “account number”; this identifcation number is valid only in relation to transactions in the LifeMiles program. The member's identifcation number is not valid for identifcation purposes that are not related to the LifeMiles program. After completing enrollment in the LifeMiles program, new members receive a correspondence pack and/or an email welcoming them to LifeMiles which also contains their PIN number and / or password. This PIN and/or password will allow the member to access their account information at any time through the www.LifeMiles.com website and will allow access to a variety of self-service options, and the ability to perform certain transactions, without which it would be necessary to make in person at any of the Avianca and / or TACA customer service centers. The member is solely responsible for the use of their PIN and/or password and for maintaining its confdentiality, which should not therefore be divulged to third parties. If so, the partner will be solely responsible for any and all actions of said third party using the PIN and/or password, including but not limited to any transaction within the member's account, any violation of the terms and conditions of the LifeMiles program, and any further disclosure of the PIN and/or password. Avianca and TACA shall not be liable for any loss or action resulting from access or unauthorized use of the member’s PIN and/or password.



Avianca and TACA may share personal information about program members with each other, as well as any third party who perform administrative work, advertising, operate or manage the program. LifeMiles may also contract third parties to process member information on behalf of LifeMiles; however, these parties must comply with all Avianca and TACA regulations and privacy policies when processing said information. If the LifeMiles member provides an email address, LifeMiles may send emails to that address related to the transactions performed by the member in the program, as well as account statements, among others.

In addition, the member gives permission for Avianca, TACA and / or LifeMiles to obtain, compile, exchange, update, collect, process, reproduce or make the data or information available, completely or in part, of members enrolled in the program, as well as the transfer of said data or information, completely or in part, to other countries and their businesses, companies, afliates or participants, so that both LifeMiles and such entities can ofer their products or services to members, as well as to provide a better experience to members in the program. •

Security regulations in diferent countries may require that Avianca and TACA give certain ofces and government agencies access to the information provided by partners. Avianca and TACA may disclose personal information of LifeMiles members, with or without the member’s consent, to government authorities or third parties according to legal requirements or any appropriate authority, strictly limiting the information disclosed to that which is legally required.



Avianca and TACA reserve the right to audit members’ accounts at any time and without having to notify the member in order to ensure compliance with the LifeMiles terms and conditions and the conditions of airline transportation and / or tarifs. In the event that an audit reveals discrepancies and / or violations, the processing of award tickets, mileage accrual and other benefts may be suspended until such discrepancies and / or violations are resolved to the satisfaction of Avianca and TACA. In such cases and until a resolution is reached, the member may not redeem miles, award tickets or other benefts as determined by Avianca and TACA.



Membership of the LifeMiles program is a privilege that can be revoked by Avianca or TACA at any time at their sole discretion and without liability for compensation to the member, and without recognizing mileage accumulated at the moment the member’s account is terminated or suspended in cases including, but not limited to, fraud, breach and / or violation of the LifeMiles terms and conditions, or when in the opinion of Avianca or TACA, the partner is involved in actions that damage any Avianca or TACA assets, its companies, afliates or subsidiaries, as well as any act of verbal or physical abuse to any of the assistants, ofcers or agents of such entities, regardless of whether it is determined that the member bears any responsibility, be it criminal, civil or of any other nature, or any breach of any other applicable regulations, including but not limited to conditions of carriage, tarifs and other Avianca and TACA conditions. The penalties for such actions might include, but are not limited to, loss of all benefts, award tickets and mileage balance in the member's account, as well as cancellation of the member's account and future participation in the program. Avianca and TACA also reserve the right to take any legal action deemed appropriate to recover damages and losses that may have been caused, including legal fees.



Members whose account is terminated in accordance with the terms and conditions of the program will be ineligible to open a new account. In the case that Avianca and TACA, at their sole discretion, decide not to terminate the member's account and allow them to remain in the program, may take other measures such as reducing the miles balance in the member's account, notwithstanding recourse to legal remedies to which Avianca and / or TACA may have access according to applicable legislation.



The LifeMiles program disclaims all and any liability with regard to the provision of services of any of the airlines, businesses, afliates or participants. All claims in respect of said services should only be directed to those entities.

Accumulation of Miles •

Miles will accrue from the start of membership when the member gets their account number. The number of miles credited depends on the conditions of accumulation that exist in the program when the services are utilized.



To ensure that the member receives mileage credit for any applicable transaction, they must present their LifeMiles account number when making fight reservations with program afliated airlines, when using any of the program services or purchasing products with afliated and/or participating businesses. The member must retain all applicable fight documents until the mileage is credited to their account. For transactions with afliated and/or participating businesses, the member must retain the original sales receipt, original invoice, or any other evidentiary documentation. The miles that the member wants to accumulate through afliated and/or participating businesses must be requested directly from each of these entities, which may be accredited in accordance with the policies and procedures established by them.



Members can monitor the accreditation of miles in their accounts through the account statements that are sent to their email address monthly (if one was provided), or through the www.LifeMiles.com website. It is the sole responsibility of the member to make sure that miles earned are correctly credited to their account, for which they may be required to submit satisfactory supporting documentation to Avianca and TACA, which may include boarding tickets, receipts, invoices or other items.



Any complaint regarding a member’s LifeMiles statement must be fled within six (6) months following the transaction. Claims will not be accepted outside that period. A member can make an application for accreditation of miles not registered in their account through the www.LifeMIles.com website, via the Call Center, or by visiting an Avianca or TACA Customer Service Center. For miles not credited for transactions with afliates and participating businesses, the member must apply to the respective institution, which will send a corresponding LifeMiles request.



It is permitted to request credit for miles on past transactions that meet the requirements up until six (6) months after the date of the transaction according to the terms and conditions established herein, presenting the required supporting documentation. LifeMiles reserves the right to verify all documentation submitted for extemporaneous accreditation. Retroactive accreditation is not allowed for fights with afliated airlines or LifeMiles participants or for any type of transaction with businesses or afliated and / or participating entities that have been conducted before the member's enrollment in the program.



Miles accrued in members’ accounts are solely and exclusively those awarded for fights with fully paid tickets on Avianca, TACA and other airlines afliated to the program, and according to the terms and conditions established for accumulation by each of these airlines. Miles can also be earned for products or services purchased through businesses, companies or entities afliated or participating in the program as stipulated in the respective trade agreements, as well as the bonuses generated through promotions agreed between the program and its afliated businesses, or miles resulting from any authorized transaction according to the LifeMiles terms and conditions; therefore, should miles be accumulated that do not belong to the account holder, LifeMiles reserves the right to discount them from the account and / or to charge them to the account holder according to established policies and to any other remedy provided in the terms and conditions in the event that it can be determined or it is suspected that the member is directly responsible for said fraud.



The miles will only be credited to the member's account when fying or purchasing services or products from other afliated businesses or participants. The miles may be accumulated when the member buys a fight ticket from any of the outlets of participating airlines; the miles earned will be refected in the member's account upon completion of the trip with any of the said airlines or when the service or product of the businesses, companies or entities afliated or participating in the program is received, according to the terms and conditions of said entities. Miles will not be credited for canceled fights or when the passenger is accommodated with another carrier, unless permitted by the participating airlines, at their sole discretion.



The permitted accumulation rates for miles on Avianca and TACA fights will be determined by Avianca and TACA, and may be changed without notice and with immediate efect. The fights, fares and classes, among others, of other airlines afliated to the program that allow accumulation of miles, will be determined by the agreements that exist with said airlines and the conditions defned by each one. On using the services of afliated airlines, the member must verify the individual conditions in force for each, as these airlines may change their terms and conditions at any time without notice. The afliated airlines are solely responsible for the accreditation of miles for their services.



The member shall be entitled to receive a certain number of miles in their account for each fully completed fight that was bought at a tarif and segment eligible to receive miles. The number of miles to be accredited will depend on existing agreements with airlines participating in the program, as well as the terms and conditions of accumulation of those airlines. To calculate this number, airlines may take the following factors into account, among others (i) the distance traveled or the minimum amount of miles fxed by their policies, according to the distance between the departure and arrival points indicated on the ticket; in the case of direct fights, with or without stops, the miles credited to the member's account may be those of the total segment; for connecting fights and change of aircraft or fight number, the miles will be calculated

on the basis of partial segments fown, (ii) for the type of fare and / or service class used on international and domestic fights, accrual may be based on the actual miles fown with a minimum established by each airline according to its own policies, and (iii) any other factor that the airlines use to determine the number of miles to be credited, at their sole discretion. •

Program members who are also members of other similar programs belonging to other airlines may only earn miles in one program for a particular fight, they may choose which. After the miles have been credited to an account or specifc program, it cannot be changed or the allocation of credited miles reversed. The member will not accrue miles when fights with the afliated LifeMiles airlines are annulled or cancelled for reasons beyond their control (including cancellations for internal or external strikes or for security reasons).



The miles may be added once per journey, regardless of the number of seats purchased by the member unless indicated otherwise by LifeMiles, miles will NOT be credited to the member's account in the case of: • Flight tickets used on airlines that are not afliated to or participating in LifeMiles. • Flight tickets that are unused or refunded. • Flight tickets that are lost or expired. • Flight tickets issued with trading partners with SOCCOM or SOCOM tarifs. • Flight tickets issued with student fares, TACA Vacations, wholesale, marine or GSA. • Flight tickets with unpublished tarifs. • Award tickets or airline tickets obtained through special promotions. • Flight tickets that are free, charters, "tour conductor" tickets, airline employee tickets or others traveling with any kind of pass, beneft or discount.



The benefts obtained in the form of LifeMiles awards will not give rise to any accumulation of miles, except where established within the product specifcations.



Avianca and TACA are the only authority who can determine when miles should be credited to the member’s account and reserves the right to deny or revoke said miles when at its sole discretion the accreditation was made in error.



If Avianca and TACA or any afliated entity or LifeMiles participant incorrectly denies accreditation of miles, award tickets or any other beneft to any member, the only right the member shall have will be the accreditation of the miles that were denied, the award ticket or beneft if available or possible, or any other comparable alternative beneft, as determined by Avianca or TACA, who will bear no additional liability. In no event will Avianca and TACA or any afliated entity or program participant be liable to any member, or representative of the member, for any direct or indirect damages derived from or as a consequence of this denial, for the loss of revenue or profts arising from or in connection with acts or omissions of Avianca and TACA or any of its afliated entities or participants with respect to LifeMiles.



Units from certain loyalty programs of companies, businesses or afliated entities or participants can be converted into miles for transfer into a member’s LifeMiles account, according to the equivalence tables in force at the time. The member may consult program information of companies, businesses or afliated entities or participants, the conditions for converting miles and their transfer, through www.LifeMiles.com; the miles credited to the member's account will adopt the general rules of validity defned in these terms and conditions.

Redeeming Miles •

The miles may be used for the purposes expressly stated herein or as stated in the LifeMiles media. LifeMiles members may use their account miles to redeem Avianca and TACA products or services or those of any of the businesses afliated to or participating in the program, according to the list in efect at the time of redemption. Such entities may include airlines, hotels, rental cars, online catalog products, activities, tours, theme parks, pharmacies, dry cleaners, beauty salons and restaurants, among others. The redemption process for such benefts, rewards and award tickets is always available on the www.LifeMiles.com website.



Only Avianca and TACA can decide the number of miles required for redemption of a reward, beneft or award ticket. The number of miles needed to redeem an award ticket can be found when the award ticket is quoted through the www.LifeMiles.com website. This amount will depend on the origin and destination of the fight, the class in which the member wants to redeem the miles and its attributes, the season and demand, among others.



Avianca and TACA shall not be liable under any circumstances for those awards redeemed for products or services granted by afliated businesses and entities or LifeMiles program participants. Those entities shall be solely responsible for ensuring the products or services granted by them. It is the member’s responsibility to know the restrictions, terms and conditions of the use of the LifeMiles awards. Neither Avianca and TACA nor LifeMiles have direct control over these entities and therefore cannot be held responsible for the continuity or availability of services or products ofered by businesses and afliated entities or program participants. Avianca and TACA are not responsible for the withdrawal of any of the businesses and afliated entities or program participants, the cancellation of benefts or awards, discontinuity in services, changes in mileage levels required as well as their rules, policies and restrictions. Restrictions on the awards and benefts may be amended at any time by Avianca or TACA, by LifeMiles or by afliated entities or program participants.



The availability of rewards, benefts and / or award tickets may depend on the dates, season and destination, among others. Specifc benefts and rewards, as well as certain destinations may not be available at all times or they may be subject to limited availability.



Subject to these terms and conditions, including the regulations that prohibit buying or selling miles, benefts and award tickets, the award tickets may be redeemed on behalf of the person indicated by the member. Once the award ticket has been issued, this may not be transferred in any way. Passengers must carry an identifcation document to be used throughout the journey and must show it on request of any of the airlines’ agents.



Award tickets do not apply to fights on Avianca, TACA and other afliated airlines that are operated through code-share agreements with other airlines. Similarly, fights operated by airlines outside the program under any agreement with the afliated airlines, cannot be used with an award ticket, unless indicated by LifeMiles.



Award tickets for international fights will be subject to all relevant government approvals. Similarly, the use of award tickets is restricted to all the general carriage conditions of the airline operating the fight, the tarifs and charges, ticket conditions and all policies, together with all applicable international treaties, as well as by all the terms and conditions of the LifeMiles program.



It is the sole responsibility of the LifeMiles member to pay any fee, charge, and generally any amount that is imposed by way of duty, tax, levy or fee to be paid to any public or private entity through the redemption of award tickets or any other award or beneft derived from the LifeMiles program. Details of the fees, charges and taxes that apply to an award ticket or any other LifeMiles program beneft can be consulted when receiving a quote or making a redemption through the www.LifeMiles.com website.



Redeeming miles or issuing award tickets may be subject to an administrative fee imposed by LifeMiles, which must be paid by the member at the time of redemption. This administrative fee may vary by type of award, or according to the origin / destination chosen by the member, among others.



Avianca and TACA may transfer ownership of the program as well as outsource its administration to another entity (including but not limited to its operational management, advertising, etc.), without notifying the program’s members. In such case, that entity will have the same rights and powers as Avianca and TACA under these terms and conditions, or as agreed in the respective documentation.



LifeMiles will be the fnal authority and jurisdiction with respect to the interpretation of these terms and conditions.



In the case that Avianca and TACA do not take action, it does not constitute a waiver of any present or future breach of the program by any member. If any provision under these terms and conditions is determined to be invalid, void or illegal by a relevant authority, such provision shall be adjusted only to the extent that such invalidity, illegality or invalidity is corrected and shall not afect the validity of the remaining provisions.
