TERM OF REFERENCE THE 4TH ANTI-CORRUPTION FORUM MEETING Jakarta, 10-12 June 2014 A. Background The efforts on combating corruption in Indonesia have reached a better achievement on a yearly basis, as shown with the increased score achieved on the Corruption Perception Index (CPI) for at least the last eight years (2004-2011). However, the score has yet to increase for 2012-2013, even though Transparency International has changed the scoring system, from 0-10 to 0-100; thus, the Indonesia’s score is 32/100. It can be said that the efforts on corruption eradication have been stagnant for the last two years. Hence, we have realized that the score achieved is far from an ideal score, which would be 100 (the cleanest), and as a result it is recommended Indonesia improves all efforts pertaining to the prevention and eradication of corruption. Indonesia’s Corruption Perception Index score (2004 – 2013)

The commitment of Indonesia’s government to eradicate corruption, along with other countries, has been proven through the ratification of the United Nations Convention Against Corruption through the law No. 7 of 2006. As a state party, it is mandatory for Indonesia to implement UNCAC. Regarding the general implementation of UNCAC, , Indonesia has already implemented it through the harmonization and synchronization of several laws and regulations, as found within UNCAC. However, based on the UNCAC gap analyses conducted by KPK, it is found that several articles are not fully adopted within Indonesia’s laws and regulations.1 Indonesia has been reviewed by Uzbekistan and the United Kingdom in 2010 regarding the implementation of UNCAC, which resulted in 32 recommendations. These recommendations are expected to be followed up by the government of Indonesia through in-lining laws and regulations with UNCAC. From all 32 recommendations, 25 require adjusting existing laws and regulations, which consist of the following:      

9 recommendations on the criminalization of corruption; 2 recommendations regarding legal provisions in the Penal Code; 1 recommendation regarding asset forfeiture; 2 recommendations regarding extradition; 9 recommendations regarding mutual legal assistance; 2 recommendations regarding other regulations.

Based on the above 25 recommendations related to the laws and regulations, the Government of Indonesia has already implemented 13 recommendations (47%) through several laws and regulations. Nevertheless, some recommendations have not been adopted and still require amending current laws. Similarly, a study has found that not every recommendation can be 1

accommodated through national legislation due to the difference of the legal systems, as well as national interests and sovereignty. To ensure that UNCAC will be implemented properly, the government of Indonesia has launched the National Strategy of Prevention and Eradication of Corruption through the Presidential Regulation No. 55/2012 regarding the National Strategy of Prevention and Eradication of Corruption, the long term plan 2012-2015 and medium term 2012-2014. All 6 (six) strategies found within the National Strategy of Prevention and Eradication of Corruption refer to UNCAC: (a) prevention; (b) law enforcement; (c) synchronizing and harmonizing laws and regulations; (d) international cooperation and asset recovery; (e) education and anti-corruption culture; and (f) reports mechanism. All six strategies are in-line with UNCAC in order to achieve key result indicators of the National Strategy of Prevention and Eradication of Corruption, which are the Corruption Perception Index, the synchronizing of the Indonesian regulation with UNCAC, and the National Integrity System Index. The National Strategy of the Prevention and Eradication of Corruption is implemented through several annual prevention and eradication corruption activites, involving ministries and institutions, as well as the regional government. Precisely, three action steps of the Prevention and Eradication of Corruption have been implemented: the 2011 Action of CPE based on the Presidential Instruction No. 9 of 2011; the 2012 Action of CPE based on the Presidential Instruction No. 17 of 2011, and also the 2013 Action of CPE based on the Presidential Instruction No. 1 of 2013. The involvement of ministries and institutions was increased on a yearly basis, while the regional government’s involvement in this action began in 2013 with significant numbers (111). The 2014 Action of CPE will involve all ministries and institutions, as well as the regional government. One of the “blind spots” of the National Strategy of CPE is that there is nothing pertaining to corruption in politics. Corruption in politics itself has a specific role on the increase or decrease of the CPI of a particular country, and Indonesia is not excluded. Therefore, the coordination between the executive, the legislative and the judiciary in supporting the targeted achievements on the prevention and eradication of corruption is mandatory. Various efforts regarding corruption prevention and eradication have been conducted and implemented by the Government of Indonesia, and will require public oversight, as mentioned clearly in the article 9 of the Presidential regulation No. 55 of 2012 regarding public involvement in the National Strategy of CPE. In fact, it is written that, “… in implementation of National Strategy of CPE, the Ministries, Institutions and regional government will involving public (verse 1)”, “This public involvement begun in the level of planning, implementation, monitoring, evaluation and reporting (verse 2),” “and adjusted to the specific condition of its ministries, Institutions and regional government (verse 3).” Furthermore, Part D, Chapter III of the Regulation of Minister of National Planning and Development No. 1 Year 2013 regarding the mechanism of Coordination, Monitoring, Evaluation, and Reporting of the National Strategy of Prevention and Eradication of Corruption also describes the General framework of Public participation on the National Strategy of CPE: a.

Involving the public in the National Strategy of CPE is not only inline with respecting the public’s rights to be involved in the policy decision process and development, but is also an opportunity to learn and support targeted achievements regarding the sustainability of the prevention and eradication of corruption. The public has its own right to conduct independent oversight, particularly civil society organizations, academics, journalists and professional associations. They can monitor and score

the achievements of prevention and eradication of corruption within ministries, institutions and regional governments, every three months, as well as on a yearly basis. Public monitoring can be used as a verification and validation tool for the internal monitoring report concerning the implementation, which is conducted by regional governments, ministries and institutions. The public is welcomed to send its independent report to the Ministry of Home Affairs as well as the Ministry of National Planning and Development to provide inputs to the evaluation of the achievements of the National Strategy of prevention and eradication of corruption. Simultaneously, the public is also requested to increase its awareness, knowledge and understanding regarding the National Strategy of prevention and eradication of corruption and support the deployment of resources for organizing and implementing the agenda pertaining to the prevention and eradication of corruption. Activities that can be done to increase public participation include: 1) Development of coalitions such as the Anti-Corruption Forum or any other related programs, which aim at guarding and escorting all implementation steps within each ministries, institutions and regional governments; 2) Developing annual independent reports regarding the implementation of the prevention and eradication of corruption at all levels – i.e. city, district, provincial and national; 3) Developing information technologies as independent oversight systems using spatial data, which can be used as an alternative validation measure along with the report produced by the government; 4) Developing an interactive communication model with an officer in charge of the monitoring and evaluation of the National Strategy of prevention and eradication of corruption, both at the national and regional level;

The Presidential Regulation No. 81 Year 2010 regarding the Grand Design of Bureaucratic Reform is a part of corruption prevention and contains the following objectives: • reduce or eliminate the issue of misuse of power by the authority in each institution; • adopt a more efficient form of bureaucracy; • improve public services provided; • improve the quality of policy and institutional program’s framework; • improve efficiency in the implementation of all organizational tasks, in terms of cost and time; • establish a more anticipative, proactive, and effective Indonesian bureaucracy oriented towards globalization and environmental changes. The bureaucratic reform is related to a thousand overlapping steps undertaken by the government, thus involving an incredible amount of officers, as well as a considerable budget. Besides, the bureaucratic reform requires rearranging the bureaucracy process from highest to lowest, while also requiring innovative breakthroughs caracterised by gradual, realistic, and concrete steps that involve a new paradigm, as well as thinking outside the box to mobilize tremendous effots which do not involve doing business as usual. Therefore, the bureaucracy reform should revise and develop further regulations, update existing policies, as well as national and regional governmental management practices, and adjust the tasks and functions of each governmental institution in accordance with a paradigm shift.

Previous studies show that both the Presidential Regulation No. 55 Year 2012 regarding the National Strategy of Prevention and Eradication of Corruption and the Regulation of Minister of National Planning and Development No. 1 Year 2013 regarding Mechanisms of Coordination, Monitoring, Evaluation and Reporting of the National Strategy have already provided clear guidance for public participation within the national strategy of prevention and eradication of corruption. Following several claims, obstacles found in these policies concern the fact that these cannot be fully implemented. Firstly, the public is not well informed of both policies, including anti-corruption activists from civil society, academia, journalism, and professional associations. Secondly, on the government’ side, particularly at the regional level, it is found that issues concerned the public’s involvement and participation within policy development, Thirdly, there is no political engagement of civil society within the government agenda, particularly pertaining to the prevention and eradication of corruption. However, some civil society organizations are regularly involved in the implementation efforts of the National Strategy of prevention and Eradication of Corruption at a national level, but this number decreases significantly at the regional level. As there is a growing need to support further involvement and participation of all stakeholders within the prevention and eradication of corruption, the Anti-Forum meeting remains significantly important. Following this meeting, it is expected that more civil society organizations, academics, media and public sector officials will be involved in the anti-corruption movement. B. Objective Page 5 of 13

a. The objectives for the 4th Anti-Corruption Forum meeting are 1. Facilitating a multi stakeholder’s approach for the strengthening and monitoring of the National Strategy on Anti – Corruption , UNCAC implementation, and bureaucracy reform. 2. Assisting multi stakeholders in paying attention and focusing on sectors which are identified as being highly vulnerable to corruption 3. Obtaining wider public support for corruption eradication 4. Facilitating public dialogues on mapping challenges regarding bureaucratic reforms. 5. Strengthening the Anti-corruption network and actors. b. Specifically, the 4th AC Forum meeting will be the right forum to conduct and produce: 1. Independent evaluations by civil society organizations regarding UNCAC’s and National Anti –Corruption Strategy implementation 2. Dissemination of studies based on UNCAC’s Indonesia Country Review 3. Strategic ideas and recommendations for action of the Prevention and Eradication of Corruption as proposed by multi stakeholders, which will have a direct impact on the community. C. Outputs The expected result from the 4th AC Forum meeting is a joint formula developed in the form of: 1. AC Forum recommendations on the strengthening efforts on prevention and eradication of corruption and in-line with UNCAC. 2. AC Forum recommendations on the acceleration efforts to support corruption prevention and eradication and in-line with the effort to achieve targeted CPI. 3. Recommendation on the Corruption prevention and eradication actions proposed by researchers and civil society as implementations and follow up of the result of UNCAC studies. 4. Provide D. Outcome The outcomes expected from this 4th AC Forum meeting are: 1. Built and strengthening network between civil society, government, and Anti-Corruption Activists in Indonesia pertaining to the implemention of strategic policies regarding the National Strategy of Corruption Prevention and Eradication 2. Commitment of multi stakeholders to jointly participate in the implementation of the National Strategy of Corruption Prevention and Eradication 3. Documentation and proceedings of Anti Corruption agendas and bureaucratic reform as inputs and notes for the new government. E. Activities The 4th AC Forum meeting will include seminars and focus group discussions involving multistakeholders, as well as information technologies to reach a wider audience. F. Topics Various topics which will be discussed at the 4th AC Forum meeting include: 1. The 2014 Action of Prevention and Eradication of Corruption 2.
