General Regulations Eligibility     



Only members of the Undergraduate Student Body may run for, apply, be elected to or hold office or title within the Student Government Association. Candidates for a Student Body Officer position must be a full-time student. Candidates for office or title must have a cumulative GPA of 2.50 at the time of filing, and must maintain this GPA throughout their term. This academic requirement is effective for all candidates. Candidates for office or title may not be under active sanction at the time of filing. Any member of the Student Government Association whose cumulative GPA or semester GPA falls below 2.50, or who withdraws, graduates from the university, or studies abroad will be considered as having resigned his or her position. The SGA advisor will verify eligibility of candidates at the time of filing.

Filing   

The filing period will be set by the Elections & Regulations (E&R) Committee and will begin a minimum of four weeks prior to an election and continues for at least two weeks. In order to fulfill this requirement all interested students must complete an online application distributed by the E&R Committee. Election information sessions will be mandatory for all interested students and will be used to explain the provisions of this Code and answer questions about the elections, procedures, and the Code. 

Elections 

General elections will be held in April and can run no more than 36 consecutive hours. o Each person intending to vote online must be validated or confirmed as a student before voting. o The E&R Committee, with the approval of the House, has the power to determine the voting method used if such a determination occurs at least three (3) weeks in advance of the election. o All undergraduate students are eligible to vote.

Results   

All candidates for positions will be informed of the results of the election as soon as possible after the election.  Results of all elections, referenda, and ratification of constitutional amendments including vote counts will be posted and released to TCUaffiliated media directly following the election.  The E&R Chair will read the results of the election into the minutes at the first House meeting following the completion of the election. 

Campaigning 

Campaigning is “any public action initiated by either a candidate or a member of a candidate’s campaign staff to persuade members of the student body to vote for or against one or more candidates.” 



You can only campaign during the campaign period:  o Campaigning will begin at midnight two weeks prior to the first day of a general election and will continue until the polls close on the day of the election. 



Campaigning is allowed anywhere on campus, but only on campus (includes stationary materials, debates, rallies, etc). If you want to campaign in residence halls, you must have permission of the respective hall director. 



Posters may only be placed on stakes or university bulletin boards and they must be no larger than 520 square inches. They may not be placed on windows, doors, walls, sidewalks, streetlights, benches or any other university property. Signs or posters from YOUR campaign may not be placed within 5 ft of each other. 



A candidate can speak at student organization meetings with the approval of the organization’s president or equivalent. Candidates may contact a president before the campaign period starts as long as they do not state the specific position they are running for. 



Wearing campaign apparel, organizing rallies (with notification to the E&R Chair), distributing flyers and other promotional items, buying advertising in campus or online publications, creating websites, and utilizing social media are all permissible and encouraged campaign methods. 



No unsolicited e-mails, phone calls, or mailings. You can ask for students’ contact information in person but you cannot use TCU Announce or other mailing lists that are not created for the explicit purpose of campaigning. In other words, you must have the explicit prior permission of the recipient. Utilizing personal contact lists and social media is not considered unsolicited. 



Election day restrictions:  o You cannot campaign within 50 ft of a grouping of 3 or more computers (excluding residence halls). 

You cannot create your own voting booths—candidates, campaign staffs or staff surrogates may not solicit votes with any electronic devices which a student may cast a vote or access the polling portal.

o

Clean up—campaign materials must be removed within 36 hours after the closing of the polls.

Campaign Violations/Appeal Process 

Any candidate who willfully—: o

Exceeds the campaign spending limits;

o

Misstates campaign expenses;

o

Uses campaign methods not covered in the Election Code;

o

Violates the University Code of Student Conduct or other applicable university and SGA policies;

o

Engages in any form of negative campaigning including defamation of character, libel, or slander against other candidates or members of the E&R Committee and removing or altering an opponent’s campaign materials or materials published by the E&R Committee;

o

Roams with electronic devices with the intent of soliciting votes;

during the conduction of a campaign shall be found in violation of this code and will be subject to fines and/or sanctions as deemed necessary by the E&R Committee. 

The reporting and enforcing of violations (and appeal process) will proceed through the following steps: 1. Violations will be reported to the E&R Committee 2. The E&R Committee will commence an investigation and/or conduct hearings on the alleged violation(s) no later than 15 days after the alleged violation occurred. In the case of a confirmed violation, the E&R Committee will impose fines/sanctions. 3. The Judicial Board will act as an appellate court for election violation decisions contested by the sanctioned candidate. Appealed decisions pertinent to elections must be made within 48 hours. If the Judicial Board does not meet, the E&R Committee decision stands.



NOTE: The E&R Committee will consider possible violations during the weekly committee meeting. The Judicial Board will meet to hear appeals as needed. If the Judicial Board does not meet within two weeks of the appeal the E&R decision will stand.

Representative Elections Eligibility 

Candidates for House Representatives must meet the general eligibility requirements as stated previously, and be enrolled in at least 6 semester hours throughout their term.

Term 

Membership in the House will be exclusively defined as the result of being elected to the House to represent a constituency. Members of the House will serve for the duration of the session to which they were elected.

Calendar 

The Chair of the E&R Committee will set the dates for the elections of the House members to be no later than two weeks before spring semester finals, with the exception of the two First Year representatives, whose elections will be held within the first month of their first fall semester.

Election Procedures 



House elections are subject to the following restrictions: o

All representatives will be elected by the constituency they belong to and will represent that constituency.

o

Candidates will file with the E&R Chair for no more than 2 constituencies they are willing and able to represent. A roster of candidates will be maintained.

o

The House will apportion itself every spring to fulfill the requirements set forth in the Constitution. The E&R Chair will submit legislation prior to the beginning of filing to redistribute the academic seats in the House for the following session according to the headcounts published by the university.

The procedure governing the election of all representatives shall have the following provisions: o

The E&R Chair, with the help of the SGA advisors, will allocate the seats won through vote counts and number of constituencies ran for, as deemed necessary to fill House.

o

Candidates for Representatives are limited to spending no more than $100.00 for their campaign including donations. 6

Vacancies in House will be filled using the direct appointment process as outlined in the Student Body Code.



Oath o

The Speaker of the House shall take the oath of all newly elected representatives at the regular House meeting directly following the election. The oath shall be as follows: 

“I (state your name) do most solemnly and sincerely swear to faithfully serve the students of Texas Christian University, to represent the interests of my constituency and the student body as a whole and to maintain and uphold the constitution of the student body, so help me God.”



The religious reference may be omitted at the request of the representative taking the oath.

House Executive Board Elections Eligibility 

Candidates for the House Executive Board must meet the general eligibility requirements, and all representative requirements as stated previously.



Any candidate for Standing Committee Chair or Speaker of the House must have served in the House of Representatives, or on the respective committee, for at least one semester prior to the semester they assume the position.

Committee Chairs 



Members of House will elect the Chairs of the standing legislative committees of the House as follows: o

Members of the student body shall file applications with the E&R Chair.

o

The deadline for the application will be no later than the Monday before University designated study days.

o

All statements by qualified applicants must be made available to members of the House.

o

Nominations from the floor for Committee Chair positions will be taken only if a chair position has one or no applicants.

o

The chairs of the committees will be those receiving a majority of secret ballots cast by the members of the House at the first House meeting of a new session, and will take office upon election.

o

In the event of a vacancy in office or in filing, the Executive Board will appoint a qualified replacement with approval of a simple majority of the House.

Oath o

The Speaker of the House shall take the oath of all newly elected or appointed House officers at the regular House meeting directly following the election or appointment. The oath shall be as follows: 

“I (state your name) do most solemnly and sincerely swear to faithfully serve the students of Texas Christian University, to execute the duties and responsibilities of the office I hold and to maintain and uphold the constitution of the student body, so help me God.”



The religious reference may be omitted at the request of the officer taking the oath. 8

Speaker of the House 

Members of House will elect the Speaker of the House as follows: o

Members of House may file applications with the E&R Chair.

o

The deadline for the application will be no later than the Monday before University designated study days.

o

All statements by qualified applicants must be made available to the members of the House.

o

Nominations from the floor for the Speaker of the House will be taken only if there are one or no applicants.

o

The Speaker of the House will be the applicant receiving a majority of secret ballots cast by the members of the House at the opening of the first regular meeting and will take office upon election.

o

In the event of a vacancy of office, new elections will be held as set forth by the method delineated above.

o In case of vacancy of Speaker of the House, the Vice President of Operations will assume the powers and responsibilities of the Speaker until a new Speaker is elected. Elections will be held at the next meeting of the House. 

Oath o

The incumbent Speaker of the House shall take the oath of the newly elected or appointed Speaker of the House at the regular House meeting directly following the election or appointment. The oath shall be as follows: 

“I (state your name) do most solemnly and sincerely swear to faithfully serve the students of Texas Christian University, to execute the duties and responsibilities of the office I hold and to maintain and uphold the constitution of the student body, so help me God.”

Student Body Officer Elections Student Body Officer (SBO) candidates must abide by all General Regulations listed above in addition to the special provisions below.

Eligibility 

At the time of filing all candidates must: o Be full-time (12+ semester hours) members of the undergraduate student body; 

Have attended the university for a minimum of three full semesters, excluding summer terms;



Have attained a minimum cumulative GPA of 2.50;



Intend to maintain a cumulative and semester GPA of 2.50 throughout his or her term;



Have served a minimum of one semester as a member of the Student Government Association;



Not be an officer in more than a total of two recognized student organizations;



The SGA Advisor will verify the eligibility of candidates at the time of filing.



Presidential candidates must have completed or will have completed by the start of the subsequent fall semester a minimum of sixty credit hours.



Vice Presidential Candidates (both positions) and Treasurer must have completed or will have completed by the start of the subsequent fall semester a minimum of forty-five credit hours.

Term 

Student Body officers will serve April to April terms.

Filing 

All candidates must submit a completed Declaration of Intent to the E&R Chair.



The filing period will be extended only if no person has filed for the office or position. If no one has filed for a Student Body Officer position after an extension period, then the newly elected Cabinet will appoint a person to fill the open position. The appointment must be approved by a simple majority at the first House meeting of the session.

Candidates must submit a complete list of campaign staff members during the filing period. Additional names must be submitted in writing to the E&R Chair before said members may campaign on behalf of a candidate. o



Candidates are responsible for the actions of their campaign staff, defined as any TCU student who has the consent of the candidate to execute a responsibility that works to promote and/or garner votes for the candidate.

Please turn in all documents and payments at the same time, in a single envelope. This includes Declaration of Intent, list of campaign staff, list of signatures and campaign funding request (if needed), Student Organization Endorsement Form, and the $100 deposit.

Results 

To win a position, a candidate must receive an absolute majority of the votes cast. An absolute majority is defined as being greater than 50% of votes cast excluding abstentions.



If no candidate for an office or position receives an absolute majority of the votes cast for that office, then a run-off shall be held between the two candidates receiving the most votes, on the day(s) set by the E&R Chair. 

Campaigning  

Participation in debates scheduled by the E&R Committee is very highly encouraged. 



Endorsements by student organizations may only assist in garnering votes for a candidate by means of endorsement with an endorsement form, supplied by the E&R Committee, which must be completed by the leadership of an organization and submitted to the E&R Chair prior to public disclosure of the endorsement. 



Endorsements by students or TCU affiliates with considerable notoriety or influence of the student body is prohibited, unless a previous personal relationship has been established. Candidates anticipating an endorsement by a notable student or TCU affiliate should contact the E&R chair prior to public disclosure of the endorsement. The E&R Committee has the authority to question any notable endorsements with which a previous relationship has not been established.



Endorsements by faculty or staff, including professors, administrators, and athletic employees (excluding students) is strictly prohibited.

Campaign Expenses 

Candidates are limited to $500.00 spending for the campaign, candidates in a run-off will have their total spending limit raised an additional $100.00. o In the instance that a Candidate demonstrates financial need, the E&R Chair and the SGA Advisor will consider subsidizing the cost of a campaign. o In order to be eligible for campaign funding, a candidate must submit a Campaign Funding Request form and obtain a list of 150 signatures from the student body acknowledging their faith in the candidate’s ability to hold office. Signatures must be completed on the form provided (see appendix for form). The list of signatures should be submitted to the E&R Chair during the filing period. Uncontested candidates are not eligible to receive campaign funding. o Candidates beginning to acquire signatures before the designated campaign period will not be able to disclose the position for which they are running, or discuss any issues from their intended platform. Whenever possible, candidates should follow the provided script when acquiring signatures. o All candidates interested in receiving campaign funding must meet with the SGA Advisor during the filing period. o $4000 dollars has been allotted to campaign funding, which will be dispersed equally among all candidates who qualify to receive funding. No candidate will receive more than $500. o Reimbursement will be available for candidates who order campaign materials before they have received funding, given that they qualify to receive funding.



All Student Body Officer Candidates are required to submit a report of expenses and donations to the E&R Chair. These amounts must include the actual expenses plus fair market value (appendix) of any donated materials or campaign aids. The E&R Chair will designate an appropriate deadline for the expense report to be submitted.



All candidates should keep their receipts and be prepared to submit those to the E&R Chair in the event that questions arise regarding campaign expenses. If no receipts are provided, all items will be charged at fair market value.



To be eligible to run, all candidates for student body officer must pay a $100 deposit prior to the first day of campaigning to an SGA advisor. o

If a candidate receives campaign funding from SGA they may not use the money to pay this deposit. 12

o

The full amount of the deposit will be refunded to the candidates that successfully follow all permissible campaign methods and election guidelines no later than one week after the election date.

o

Please submit the deposit by cash or check (made out to “TCU”). Checks are preferred, but cash will be accepted. Debit/credit transactions are not permissible methods of payment, and will not be accepted.

o

If a campaign violation occurs, the amount of the fine imposed by the E&R Committee will be deducted from the $100 deposit before it is refunded back to the candidate. In the event of a fine greater than the deposit, the E&R Committee may choose to retain the entire amount of the deposit and impose further fines as deemed necessary.

o

The Executive Cabinet will allocate all retained deposit money throughout the three branches of SGA as deemed necessary.

o

Candidates may not enter office until all fines have been paid.

Oath o

The Speaker of the House shall take the oath of all newly elected Student Body Officers at the regular House meeting directly following the election. The oath shall be as follows: 

“I (state your name) do most solemnly and sincerely swear to faithfully serve the students of Texas Christian University, to represent the interests of my constituency and the student body as a whole and to maintain and uphold the constitution of the student body, so help me God.”

Special Elections Filing and Election Dates 

In the event of the inability of an officer-elect to fulfill his/her duties, the E&R Committee has the responsibility to: o

Call a special election on dates to be set by the E&R Chair.

o

Set filing dates that begin no earlier than 20 academic days prior to an upcoming election and shall continue for 5 academic days.

Campaign Expenses 

Expenditures for candidates in the special election are limited to $75.00, with candidates in a run-off will have their total spending limit raised an additional $25.00.

Severability Clause 

All other election provisions and rules in the code shall be enforced for this special election with the exception of those listed above.

Constitutional Referenda 

Dates for referenda and ratification of Constitutional amendments must be announced and posted no less than 14 days and no more than 17 days before polling to permit adequate notice and publicity of all issues. o

Any vote to amend the constitution must be available through a medium open to all students, this excludes social media platforms.



All referenda or proposed Constitutional amendments must receive the majority of votes required by the Constitution and the Code to be effective.



The E&R Committee will conduct the election in one business day.



All appeals and infractions will be decided upon by the E&R Committee



If the Executive Board determines that the E&R Chair has a conflict of interest with the referendum, the Parliamentarian will assume the role of temporary E&R Chair, with all responsibilities shifting back to the original Chair after the referendum is completed. Impartiality must be maintained at all times by the committee and the chair.

You must keep all receipts to turn into the E&R Committee with Finance— if no receipt then you need to turn in a statement of the market value to the committee. Note that all market values will be validated with the E&R Committee.



The use of departmental copier codes (e.g. codes provided to committee chairs and other SGA officers) for campaign purposes is strictly prohibited and will be considered a violation of the Code of Ethics. The SGA printer and copier log will be monitored throughout the duration of filing and campaigning.

Signature Script Under the Student Body Code of Conduct, it is stated that when running for a Student Body Officer position, the candidate need 150 signatures in order to seem worthy to run. When addressing students to receive signatures you can NOT tell them what specific Student Body Officer position you are running for. You can only tell them that you are running for a Student Body Officer position.
