luncheon keynote speaker HON. RANDALL R. RADER Chief Judge United States Court of Appeals for the Federal Circuit

RANDALL R. RADER was appointed to the United States Court of Appeals for the Federal

Circuit by President George H. W. Bush in 1990 and assumed the duties of Chief Circuit Judge on June 1, 2010. He was appointed to the United States Claims Court (now the U.S. Court of Federal Claims) by President Ronald W. Reagan in 1988. Before appointment to the Court of Federal Claims, Chief Judge Rader served as Minority and Majority Chief Counsel to Subcommittees of the U.S. Senate Committee on the Judiciary. From 1975 to 1980, he served as Counsel in the House of Representatives for members serving on the Interior, Appropriations, and Ways and Means Committees. Chief Judge Rader’s most prized title may well be “Professor Rader.” As a professor, Chief Judge Rader has taught courses on patent law and other advanced intellectual property courses at university programs in the United States, Germany, Tokyo, Taipei, New Delhi, and Beijing. Chief Judge Rader has also co-authored several texts, including the most widely used textbook on U.S. patent law, Cases and Materials on Patent Law (St. Paul, Minn.: Thomson/ West 3d ed. 2009), and Patent Law in a Nutshell (St. Paul, Minn.: Thomson/West 2007) (translated into Chinese and Japanese). Chief Judge Rader has won acclaim for leading dozens of governmental and educational delegations to every continent except Antarctica, teaching rule of law and intellectual property law principles. He has received many awards for his achievements, service and teaching. He received a B.A. in English from Brigham Young University in 1974 and a J.D. from George Washington University Law School in 1978.

Software Interoperability: What Types of Non-Literal Elements of Software Are Protectable and When Can They Be Copied? U.S. common law has provided confusing and conflicting guidance on copying for interoperability and emulation. In contrast, a European statutory provision is directed specifically to interoperability. Recent decisions in the U.S. case of Oracle v. Google and the European case of SAS v. World Programming are beginning to define the boundaries of copyright law relating to functional elements of software necessary for interoperability or emulation. Learn about the rulings and implications of these cases, and take away practical advice for developing interoperable or emulation software in the face of legal uncertainty.

Contributory Liability and the Duty to Police Internet Content Unresolved principles of secondary liability in the U.S. and EU determine who has liability for what conduct on the Internet. This panel will examine emerging case law and practical questions facing the practicing lawyer advising online and content businesses, including the recent Second Circuit decision in the Viacom case and the potentially conflicting recent Ninth Circuit decision in the Veoh case, the legal standards developing independently in Europe, how to advise clients on their duty to police content, and the continuing effects of the SOPA debate.

How far can a buyer ethically go in its use of deceptive negotiation tactics to hide its identity and minimize the price it must pay for a trademark or other IP right? Can it use dummy corporations? Work through negotiators with fake names? Lie about why it wants the IP? These and other negotiation ethics questions raised by the allegations in Proview v. Do these technologies make unauthorized public performances or create infringing copies or derivative works, and do the consumers who use them engage in fair use? Learn the emerging legal standards governing these technologies, including how the Supreme Court’s Sony Betamax and the Second Circuit’s Cablevision decisions, which upheld the legality of VCRs and remote DVRs, are being applied in recent cases concerning the Aereo, ivi.com, FilmOn, and BarryDriller Internet television services and Dish Network’s Auto Hopper DVR — and the implications for the future of TV.

Your fee includes all Institute sessions, the Institute luncheon, all refreshment breaks, the cocktail reception and a copy of the Institute Syllabus (a volume of outlines, articles, forms and practical information prepared by our speakers) in electronic format. REFUNDS Any request for refunds must be in writing and postmarked, emailed, or faxed no later than March 1, 2013. All requests will be processed following the Institute.
