II.

DESCRIPTION OF THE PROJECT

The Administration des bâtiments publics (hereinafter “ABP”) is organising this international architectural design competition (hereinafter the “competition”) for the project of building an administrative complex for the European Commission (hereinafter “the Commission”) on the Kirchberg Plateau in Luxembourg. The aim of this competition is to select an architectural project and the team responsible for planning it. The building currently occupied by the Commission no longer meets the needs of its occupants and services because of its age and the increasing amount of business to be handled, particularly in the wake of the European Union's various enlargements. It is planned to construct a new building in the immediate vicinity of the current “Jean Monnet” building. This project, called “Jean Monnet 2”, will bring all the Commission departments under one roof, will be built in two phases and will form a single homogeneous unit in technical, spatial, architectural and functional terms. The current and future site of the Commission’s Jean Monnet and Jean Monnet 2 buildings are located in the part of the Kirchberg Plateau in Luxembourg called the Quartier européen (European district) because of the concentration of European institutions and administrative buildings. The site of the future Jean Monnet 2, which is bounded by the Boulevard Konrad Adenauer, Rue Erasme and Rue Antoine de Saint-Exupéry, is part of a large plot of land which the development plan envisages dividing into two parts by moving Rue Albert Wehrer.

As the surface area of the plot is 20 950 m², the gross floor area above ground for all the buildings may not exceed 120 000 m² (in accordance with the Programme Document annexed to these competition rules). The first phase is set to be completed by December 2016. It will have an estimated gross floor area of slightly more than 140 000 m², i.e. approximately 76 000 m² above ground, and will accommodate approximately 1 900 workstations and functions now in the current JMO. The second phase (after demolition of part of the current Jean Monnet) is scheduled to be completed at the end of 2019. It will have an estimated gross floor area of approximately 60 000 m² in all, i.e. approximately 44 000 m² above ground, and will accommodate some 1 000 workstations. The administrative complex will comprise offices for staff and other associated functions such as the data centre, the conference centre, restaurants, library, logistics areas, etc. The new building will have to reflect competence, dynamism and transparency vis-à-vis the European public. It must be geared to modern standards with a lucid, contemporary and attractive architectural style and open a door to the future by offering considerable flexibility and modularity, whilst integrating harmoniously into the urban environment. The building will have to be designed taking into account quality and sustainability criteria, combining functionality and energy efficiency whilst complying with the principles of a sober, effective and environmentally-friendly design. The aim is for the building to be innovative and practical in terms of energy, construction, maintenance and costs. A mark of "excellent" under the BREEAM label certification system is required. The documents annexed to these rules provide additional information on the BREEAM requirements. If there are any discrepancies, it is the BREEAM constraints that are applicable.

III.

BUDGETARY FRAMEWORK

The cost of construction, including external areas but excluding VAT, may not exceed the sum of 340 million Euros (excluding office furnishings, main contractor's fees, general expenses, demolition of the current Jean Monnet building).

IV.

LEGAL FRAMEWORK / LEGAL BASIS OF THE COMPETITION

The competition rules with their annexes, the planning document with its annexes and the replies to any questions raised during the competition will constitute the legal basis, which is binding on the awarding authority, the selection panel and the participants. By participating in the competition, applicants accept the legal basis of the competition which is subject to Luxembourg law. Luxembourg courts alone have jurisdiction. The selection panel’s decisions are final. The ranking of the projects is not subject to challenge.

V.

PARTICIPATION CRITERIA

Any groups comprising one or more companies made up of architects, engineers and energy experts (groups hereinafter called “applicants”), whose members are all established in a country having ratified the Plurilateral Agreement on Government Procurement (GPA, see Annex 4.07) and which have the capacity and experience (especially in the areas of architecture, technical and civil engineering and energy concepts) to design and build large administrative complexes, conference centres or other buildings of a similar complexity to the Jean Monnet 2 project, may submit an application. The applicants must form multidisciplinary design teams, comprising at least architects, civil engineers, technical engineers and energy experts, which will be represented by the architect. Evidence of competence in the fields of acoustics and access for the disabled must also be provided during the project competition phase. On the date of publication of the notice of the competition in the Official Journal of the European Communities, each member of the group must be authorised to exercise its profession in its country of origin. Participants must provide evidence of these qualifications.

The composition of the group may not change during the course of the competition or the project except in the case of force majeure. If need be, an associate may be added to the group to provide expert knowledge on Luxembourg legislation and regulations. Evidence of such knowledge will be compulsory during the competition phase, otherwise projects will be rejected. It is expressly forbidden for any natural or legal person to participate in several groups at the same time. The following persons are excluded from participating in the competition: a. Any member of the awarding authority’s staff who participates in preparing the rules for this competition. b. The members of the selection and preselection panels. c. Assistants, external consultants and their associates of the preselection panel, the selection panel and the awarding authority. d. Any persons related to any of the members listed under a, b and c to the second degree of kinship. e. Any persons having an association with any member listed under a, b and c. Each group selected may present only one project. Variants are not admitted.

VI.

TYPE OF COMPETITION

This competition is an international architectural competition open to participants meeting the preselection criteria set out below and announced in the competition notice published on 17/03/2010 in the Official Journal of the European Communities. The competition comprises a single phase after preselection, the contents of which are described in these rules. The competition phases are as follows: § preselection: a call will be published in the Official Journal of the European Communities, inviting applicants to declare their interest in participating. § a project competition: following preselection, the applicants selected will draw up a project aimed at devising the best urban development, architectural, technical, energetic and functional approach, ensuring that the building operates efficiently and completing the project within the budget and on schedule.

VII. GENERAL CHARACTERISTICS OF THE COMPETITION BRIEF The following are applicable for this competition: • • • • • • •

These documents and their annexes make up the competition brief which will be accessible on the internet site to applicants selected during the preselection phase. They will be posted online as required during the various phases of the competition.

VIII. COMPETITION LANGUAGES The competition brief has been drawn up only in German, English and French. Only these three languages may be used by the applicants. French will be the reference language for the competition but applicants may submit questions, their application file and their project file in one of the above three languages. All entries in the plans or any other documents must also be in one of these languages.

BASIC PRINCIPLES

The competition will be conducted in accordance with the following basic principles: • • • •

SUCCESSIVE STAGES OF THE COMPETITION

1. PRESELECTION OF APPLICANTS The applicants will have downloaded the documents needed to submit their application from the competition internet site and will forward a full application in digital form in accordance with the instructions published on the internet site to the e-mail address of the competition preselection secretariat. The awarding authority reserves the right to request all the original documents at any moment during the competition and subsequently. 2. PROJECT COMPETITION PHASE The names of the selected applicants will be published on the internet site. They will receive a letter by email inviting them to take part in the project competition and an access code to the internet site for the competition where the documents required for the project competition phase will be held. The applicants will forward their project files as set out in these rules.

XI.

ANONYMITY

1. GENERAL •



The names of the applicants to the competition will be kept confidential. The names of the applicants selected during the preselection phase and the names and projects of the applicants who have been awarded a prize will be published on the internet site. Participants are prohibited from contacting members of the selection or preselection panels, the awarding authority and all their external consultants. Failure to comply with this will result in disqualification.

2. PROJECT COMPETITION PHASE The awarding authority will take the measures necessary to maintain anonymity after the preselection phase by using the services of an appointed legal officer (hereinafter “huissier”). During the project competition phase the projects will be assessed anonymously and under the following conditions: • •





The projects shall bear neither a logo nor a signature. All the competition documents will be given a number by the “huissier”. All the project documents submitted by the participants shall contain only the information provided for by these rules and there will be no distinctive sign enabling the originators to be identified; all authorised information shall be provided in non-handwritten form. Any projects whose originator may be recognised in any manner other than simply opening the envelope will be disqualified from the competition. Computer files must not enable the applicants to be identified (particularly via their properties). The duties of the competition secretariat in the project competition phase will be entrusted to the “huissier”. Applicants are not authorised to contact anyone but the “huissier”.

Applicants shall forward the complete project file by registered mail with a request for advice of receipt or shall hand over their files against a receipt at the address of the secretariat (“huissier”) during the project competition phase. Questions: see Chapter XII.

The external package may bear only the following information: • • •

There will be three internal packages • The first will be marked “Pli N 1 – concours de projets” and will contain the documents requested for the project competition. • The second will be marked “Pli N 2 – identification” and will contain full contact details of the applicant and evidence of full knowledge of Luxembourg regulations and legislation in a white nontransparent envelope sealed with wax. • The third will be marked “Pli N 3 – maquette” and will contain the model for the competition.

XII. ADMINISTRATIVE AND TECHNICAL INFORMATION The documents will be provided free of charge. Applicants may submit questions until the date indicated in the competition timetable. The replies will be published on the internet site within 15 working days of the published deadline. In the preselection phase applicants should send their questions to the e-mail address of the preselection secretariat. During the project competition phase applicants should send their questions to the e-mail address of the project competition secretariat (“huissier”). The competition brief may be amended following the replies to applicants’ questions. The awarding authority may amend or supplement the brief up to the deadline for replying to applicants’ questions.

XIII. COMPETITION TIMETABLE The competition timetable is given in Annex 4.02. However, the awarding authority may decide to amend it.

XIV. PRESELECTION AND SELECTION PANELS This competition has been organised by the Ministère du Développement durable et des Infrastructures, represented by the Administration des bâtiments publics which nominated the preselection panel and the competition selection panel and its chairperson. The Administration des bâtiments publics is assisted by the architects office Arlette Schneiders Architectes. 1. PRESELECTION PANEL The preselection panel deliberates under the authority of the selection panel and supports it by examining the files submitted by the applicants during the preselection phase. The alternate members of the preselection panel may participate in all the preselection panel's deliberations but without voting rights. In the absence of a member, the alternate becomes the de facto member.

The files submitted by the applicants are verified for compliance with the criteria in these competition rules during the preselection phase. Likewise, the preselection panel examines the plans and the calculations made by the applicants during the project competition phase and draws up a summary analysis report, which provides the selection panel with a basis for making its decision, It is planned to verify the construction costs, the surface areas and the volumes communicated by the applicants.

The preselection panel is chaired by the chairperson. In his absence, the panel will nominate a chair for the meeting. The panel will make its decisions by consensus. If a consensus cannot be reached, decisions will be taken by a majority vote. When the votes are tied, the chair has the casting vote. The selection panel will assess the application files in accordance with the preselection criteria set out in Annex 4.04 Basis for assessing applications – preselection phase. The selection panel will examine the project files in accordance with the selection criteria set out in Annex 4.08 Basis for assessing applications – project competition phase. The panel will disqualify any project whose originator has not complied with the competition rules, the programme and any other elements of the competition. It will rule out any projects which are clearly plagiarised or unsatisfactory. In these cases no payment will be made to the project originators. The panel is quorate only if at least 10 members with voting rights, including one from the European Commission, are present. The panel's alternate members and the preselection panel's members and alternate members may participate in the selection panel’s deliberations but without voting rights. In the absence of a member, the alternate member becomes the de facto member. During the project competition phase, the selection panel will designate prize winners in accordance with the criteria set out in these competition rules and on the basis of the reports drawn up by the preselection panel. The selection panel’s deliberations are confidential; the preselection and selection panels' members and alternate members, the technical consultants and the experts are obliged to keep work on this competition confidential and must cooperate in abiding by the principle of anonymity. The secretary will draw up a record of the selection panel’s conclusions to be signed all the members of the selection panel and the secretary. The record will be made public when the projects are exhibited. After having allocated the prizes, the “huissier” will disclose details of all the projects. By participating in the competition, the applicants undertake to abide by the selection panel’s decisions, which are final.

XV.DETAILS OF THE PHASES 1. PRESELECTION PHASE The competition is restricted in the sense that it is open only to applicants selected by the selection panel on the basis of the preselection criteria. The participants will be selected on the basis of their “Application file” which shows that they qualify for the competition on the strength of the quality of the references, their experience and their financial, economic, technical and professional capacities.

a. PROCEDURE: The preselection panel will conduct an initial examination of the applications in order to verify whether they are complete and comply with the conditions set out in these rules. Selected applicants are invited to take part in the project competition phase and to draw up an architectural and technical proposal with an estimate of the costs. It should be noted that any missing information may result in the application being rejected and that the documentation submitted must be recent and valid. The awarding authority reserves the right to obtain additional information by any means necessary in order to establish whether the applicant is in a situation which disqualifies it from participating in the competition or to verify the references submitted. b. FORMAT:

All the documents to be provided by the participants shall be drawn up in A4 portrait format as pdf and doc files, except for Annex 5.24 "Table of administrative documents" and Annex 5.25 "Table of references", which are to be provided as pdf and excel files. Applicants shall supply the documents for the preselection phase as follows: •

the documents to be filled in and submitted, and the references shall be in German or English or French;



the official supporting documents shall be preferably in German or English or French or in another official language of the European Union (23 languages).

g. PRESELECTION CRITERIA: The minimum preselection criteria shall be as follows: Criterion 1. The file shall be in compliance with requirements and be accompanied by all the requested supporting documents. Criterion 2. Applicants must present, for each member of their group except experts, at least one reference of a building for tertiary use (administrative building, conference centre, hospital, combined commercial/office structure, mainly comprising offices) of not less than 70 000 m² net floor area completed over the past five years. Criterion 3. Applicants must certify, for each member of their group except experts, that they have no fewer than 10 staff with a relevant university qualification (in architecture or engineering) or equivalent. Criterion 4. Applicants must declare, for each member of their group except experts, an annual turnover of over 1.5 million euros excluding VAT over the past three years. Criterion 5. Applicants must provide, in relation to the energy expert, a reference on a building for tertiary use of at least 10 000 m² with an innovative energy concept completed over the past five years. The periods mentioned above are counted from the deadline for submitting applications. In the case of a group which has several members in the fields of architecture, civil engineering, technical engineering or several energy experts, Criteria 2-5 are required for the member assuming responsibility for the respective area (see also Chapter XVI 2). The criteria for assessing applicants and the weighting of the criteria are set out in the annex ‘Basis for assessing applications – preselection phase’ (Annex 4.04).

2. PROJECT COMPETITION a. PROCEDURE: The applicants selected on conclusion of the preselection phase will take part in a project competition aimed at devising the best urban development, architectural, technical, energetic and functional approach, ensuring that the building operates efficiently and completing the project within the budget and on schedule. The preselection panel supports the selection panel by examining the files submitted by the applicants in accordance with the criteria set out in these rules and draws up a report which is brought before the selection panel. This phase will enable the applicant to be identified with whom a contract for the remainder of the design work will be signed. b. g. FORMAT: The complete project file will comprise a hard copy and a digital version. The computer files shall be burned onto a CD. The CDs shall not bear any identification marks. The computer files will be named only as set out in these rules. The hard copy and the digital version of the project file must be identical. Otherwise the awarding authority reserves the right to decide which version is the reference version or to reject the application. Plans: • • •

The weighting of these criteria is given in the Annex ‘Basis for assessment of applications – project competition phase – Annex 4.08. The selection panel has full discretion to assess and interpret the selection criteria. i.

AWARDS AT THE END OF THE COMPETITION:

Selected applicants who have submitted a project in compliance with these rules will be paid 50 000 euros excluding VAT. The following prizes will be awarded: 1st prize:

150 000 euros excluding VAT

2nd prize:

100 000 euros excluding VAT

3rd prize:

80 000 euros excluding VAT

TOTAL:

330 000 euros excluding VAT

The selection panel reserves the right to change this breakdown as long as a total award of 330 000 euros excluding VAT is not exceeded. The winner of the competition will be the applicant obtaining the first prize as long as he has provided evidence of full knowledge of Luxembourg legislation and regulations in the areas under “V. Participation criteria".

Irrespective of the result of the competition, the awarding authority remains free, for whatever reason, to either implement the project for which the competition was held or to abandon it or to implement it later. In the event of the awarding authority deciding to go through with the project, it will choose between the prize-winning projects. However, if fewer than three prizes were awarded, it may also choose from the first three highest-ranked projects. If the awarding authority does not select the prize-winning applicant it will explain why. The awarding authority reserves the right to undertake detailed counter-analysis and verification of the prizewinning projects. This analysis will be conducted by a group of experts made up of at least two members of the preselection panel, two members of the selection panel, one of which will be from the European Commission, with a view to providing all the information and clarification which the awarding authority deems necessary for a detailed and final appreciation of the economic, constructional and, if need be, energetic aspects of the project. The awarding authority will take the decision as to whether to go through with the project as set out in the paragraph above depending on the result of these investigations. After selecting a project in accordance with the above paragraph, the awarding authority also reserves the right to request any amendment it deems necessary to optimise the project selected. The project will be adapted and subsequently implemented at the awarding authority’s request. The contract with an applicant taken from the three highest-ranked applicants will be concluded via the negotiated procedure without publication of a tender in accordance with the relevant provisions of Grand Ducal Regulation of 3 August 2009 implementing the Law of 25 June 2009 on public contracts and amending the threshold under Article 106 point 10 of the Municipal Law of 13 December 1988. The awarding authority and the selected applicant shall be bound by the contract appended to the competition rules. Given the scale of the project to be implemented, the awarding authority proposes to award an overall main contracting agreement covering the tasks of the architect, civil engineer, technical engineer, energy expert and any other specialist required to ensure that the project is properly designed, the preliminary design and detailed preliminary design, the draft financing law and the required authorisations. Award of the contract for implementing the project is not envisaged at this stage and will be defined in the course of planning. If one of the three applicants ranked highest in this competition implements the agreement partly or in full, the sum corresponding to the remuneration (50 000 euros excluding VAT) will be deemed to be an advance payment on the fee. The main contracting team will be finalised on the basis of consultation between the architect and the awarding authority. The latter reserves the right to refuse any specialist that the architect proposes. The project which is selected may be subject to certain amendments which are deemed necessary as a result of the selection panel’s recommendation and the development of the design work. The project will be amended and finalised in close cooperation with the awarding authority and no payment will be made for this (separately). The remuneration and prizes will be paid to the participants after verification of the technical compliance of their projects on presentation of an invoice.

XVI.

FOLLOW-UP TO THE COMPETITION

1. CONTRACT The main contracting agreement shall be offered to one of the three applicants ranked highest in this competition. 2. RESPONSIBILITY It is compulsory for the member of the group which has met the criteria set out in point “XV.1.g. Preselection criteria” to assume responsibility for the design and the tasks of the architect, civil engineer, technical engineer and energy concept expert.

3. PUBLICATION The projects submitted during the competition phase will be exhibited publicly and published on the internet site after the results have been announced. 4. RETURN OF DOCUMENTS AFTER THE COMPETITION After the exhibition has been closed, non-prize-winning project documents may be withdrawn from the Administration des bâtiments publics within a maximum period of 30 days. Upon request, the project documents may also be sent at the applicant's expense. 5. PROPERTY OF THE PRIZE-WINNING PROJECTS The participants’ projects become the property of the awarding authority and the European Commission which reserves the right to unlimited use of the documents submitted. The originators retain their intellectual property rights.
