In pursuance of Section 8 and 4 of the Delimitation Act, 2002 (33 of 2002), and having regard to all other enabling statutory provisions in this regard, the Delimitation Commission hereby determines –

a)

the total number of seats to be allocated to the State of Goa in the House of the People as Two (2);

b)

of the total number of Two (2) seats so allocated to the State of Goa in the House of the People, the number of seats to be reserved for the Scheduled Castes and Scheduled Tribes as Zero(0);

c)

the total number of seats to be assigned to the Legislative Assembly of the State of Goa, as Forty (40);

d)

of the total number of Forty(40) seats so assigned to the Legislative Assembly of the State of Goa, the number of seats to be reserved for the Scheduled Castes and the Scheduled Tribes as One(1) and Zero(0) respectively.

No. 282/GOA/2004- In pursuance of sub-Section(2) of Section 9 of the Delimitation Act, 2002 (33 of 2002), the Delimitation Commission hereby publishes its proposals for the delimitation of Parliamentary and Assembly Constituencies in the State of Goa along with the dissenting proposals of the Associate Members and specifies 22nd November, 2004 as the date on or after which the proposals will be further considered by it. 2.

Any objections or suggestions in regard to these proposals should reach the

Secretary, Delimitation Commission, Nirvachan Sadan, Ashoka Road, New Delhi110001, on or before the said date. PROPOSALS (i)

The territorial constituencies into which the State of Goa shall be divided for the purpose of elections to (a) the Legislative Assembly of the State, and (b) the House of the People, the extent of each such constituency and the constituencies in which the seats are reserved for the Scheduled Caste and Scheduled Tribes shall be as shown in the Table-A and Table-B respectively.

(ii)

Where the name of a constituency as shown in Table A or Table B is distinguished by the brackets and letters (SC), the seat in that constituency is reserved for the Scheduled Castes; and

(iii)

Where the name of a constituency as shown in Table-A or Table-B is distinguished by the brackets and letters (ST), the seat in that constituency is reserved for the Scheduled Tribes. (Here print the matter attached)

Sub:- Note of dissent on the delimitation of Parliamentary and Assembly Constituencies of the State of Goa. ****** In the meeting dated 15-09-2004 held at Panaji, I had made the following suggestions:

1) Ward No. 7 and 8 from Assembly Constituency No. 25-Vasco-da-Gama be shifted to Assembly Constituency No. 24-Mormugao. 2) Ward No. 19 from Assembly Constituency No. 26-Chicalim (Vaddem) be shifted to Assembly Constituency No. 25-Vasco-da-Gama. 3) Ward No. 10 and 11 from Assembly Constituency No. 24-Mormugao be shifted to Assembly Constituency No. 25-Vasco-da-Gama. 4) Ward No. 12 and 13 from Assembly Constituency No. 24-Mormugao be shifted to Assembly Constituency No. 26-Chicalim (Vaddem)

The details of the newly proposed constituencies as suggested by me are enclosed.

Since my proposal as above has not been considered by the Commission, I hereby give the Note of Dissent as above on the proposals in respect of Assembly Constituencies No. 24-Mormugao, 25-Vasco-da-Gama, 26-Vaddem and 27-Cortalim.

I further request that this Note of Dissent may please be published alongwith the Draft Proposal of the Commission.

Sub:- Note of dissent on the delimitation of Parliamentary and Assembly Constituencies of the State of Goa. ****** In the meeting dated 15-09-2004 held at Panaji, I had made the following suggestions:

1) That Ward No. 3 of Assembly Constituency 29-Curtorim be to be shifted to Assembly Constituency No. 30-Fatorda. 2) That Ward No. 16 of Assembly Constituency No. 30-Fatorda be shifted to Assembly Constituency No. 32-Benaulim. 3) That Ward No. 1 of Assembly Constituency 30-Fatorda be shifted to Assembly Constituency No. 28-Nuvem.

This suggestion was also agreed in the meeting by all the Associate Members including Member of Parliament from Mormugao Constituency Shri Churchill Alemao who had even asked the Delimitation Commission to note down his consent.

Further, I had suggested that Velim Assembly Constituency should be retained as it is under the 1976 Delimitation.

The details of my various proposals were given alongwith the plan showing how the proposal fulfils the requirement of population within the permissible limits.

The reasons for retaining Velim Assembly Constituency is that, it is accessible by major district road and the villages are historically and commercially linked. It has a large number of members of fishermen community. Therefore, by maintaining it as it is economic, social and cultural requirements of the fishermen could be met.

Velim Assembly Constituency spills over the northern side of Village Panchayat Quitola-Naquerim with Velim already existing therein and addition of Telaulim, Sarzora and Quitola-Naquerim. This Assembly Constituency is on one side of Sal river.

Similarly, it was suggested by me that Navelim Assembly Constituency should also be retained in its existing form with minor changes such as Telaulim Saza to be deleted and Sao Jose de Areal to be added.

As regards Loutulim Constituency (renamed as Nuvem) villages of Nagoa and Verna are separated from Loutulim by a hill with no road link. Loutulim forms a natural extension of the villages of Raia and Camurlim and the road link from Loutulim to Margao is only via Camurlim and Raia. The Gawda community, which is classified as Scheduled Tribe is concentrated in the villages of Raia, Rachol, Curtorim and Loutulim. Therefore, if these villages are grouped together the Gawda community will get proper attention.

As regards Fatorda Assembly Constituency, Ward No. 3 is the integral part of Margao Municipal area.

Hence it is required to be retained in Fatorda Assembly

Constituency No. 30. On the other hand, Ward No. 1 and 16 which are on the outskirts of Margao city can be allotted to Nuvem Assembly Constituency No. 28 and Benaulim Assembly Constituency No. 32 Respectively.

The existing Cuncolim Assembly Constituency may be retained as it is with addition of Avedem, Ambaulim and 2 wards Quepem Municipal Council. Avedem is an

integral part of Paroda Saza having road linkages to Cuncolim Assembly Constituency. Ambaulim and 2 wards of Quepem Municipal Council are closely connected with Cuncolim Assembly Constituency.

The details of the newly proposed Assembly Constituencies as proposed by me are enclosed. Since my proposal as above has not been considered. By the Delimitation Commission, I hereby give the Note of Dissent as above on the proposals in respect of Assembly Constituency No. 28-Loutulim, 29-Curtorim, 30-Fatorda, 31-Margao, 32Benaulim, 33-Navelim, 34-Davorlim, 35-Cuncolim, 36-Quepem and 37-Curchorem.

I further request that this Note of Dissent may please be published alongwith the Draft Proposal of the Commission.
