A RESOLUTION BY COMMUNITY DEVELOPMENT/HUMAN RESOURCES COMMITTEE AUTHORIZING THE MAYOR ON BEHALF OF THE CITY OF ATLANTA TO EXECUTE HOME INVESTMENT PARTNERSHIP PROGRAM CONTRACTUAL AGREEMENT WITH THE ATLANTA NEIGHBORHOOD DEVELOPMENT PARTNERSHIP, INC. FOR THE PURPOSE OF FACILITATING THE CONSTRUCTION, RECONSTRUCTION, AND REHABILITATION OF SMALL, AFFORDABLE RENTAL HOUSING AS WELL AS SINGLE FAMILY UNITS FOR SALE; AND FOR OTHER PURPOSES.

WHEREAS, the City of Atlanta ("City') has been awarded $1,000,000.00 from the State of Georgia Department of Community Affairs ("DCA") to facilitate the construction, reconstruction, and rehabilitation of nine (9) single family units for sale or rent in the Pittsburgh neighborhood; and WHEREAS, the properties to be redeveloped under this award will come from the existing inventory owned by the Fulton County/City of Atlanta Land Bank Authority or the Annie E. Casey Foundation; WHEREAS, pursuant to Ordinance 14-0-1327, the City has anticipated and appropriated $1,000,000.00 in DCA HOME Program funds to be used in accordance with DCA application requirements and the HOME Program regulations; and WHEREAS, The Atlanta Neighborhood Development Partnership, Inc. has been selected to redevelop four (4) existing properties in the Pittsburgh neighborhood acquired through Annie E. Casey Foundation; and WHEREAS, the City would like enter into a contractual agreement with Atlanta Neighborhood Development Partnership, Inc. in an amount not to exceed Five Hundred Thousand Dollars and no cents for a term not to exceed twenty-four (24) months. THE COUNCIL OF THE CITY OF ATLANTA, GEORGIA, HEREBY RESOLVES, that the Mayor or his designee be and is hereby authorized to enter into a contractual agreement in an amount not to exceed Five Hundred Thousand Dollars and no cents with Atlanta Neighborhood Development Partnership, Inc. for a term not to exceed twenty-four (24) months. BE FURTHER RESOLVED, that the Office of Housing is directed to prepare the contractual agreement for execution by the Mayor to be approved by the City Attorney as to form. BE IT FINALLY RESOLVED, that said contractual agreement shall not become binding upon the City, and the City shall incur no liability under same until such Contractual Agreement is approved by the City Attorney as to form, executed by the Mayor, attested to by the Municipal Clerk, and delivered to Atlanta Neighborhood Development Partnership, Inc.
