EXECUTIVE SUMMARY 1.

INITIAL INTRODUCTION The Phuoc Long 220kV substation is proposed to be built on a farming land cultivating perennial trees (includes: cashew, pepper and other fruit trees) which belongs to the Gruop No.4, Thanh Tuan hamlet, Thanh Luong commune, Binh Long district, Binh Phuoc province. The investor of the project is Southern Power Project Management Board, oh behalf of Electricity of Vietnam with total invested cost is 148,473,973,448 VND. The capital source is from the remaining budget of "System Efficiency Improvement, Equitization and Renewable" (SEIER) project, the credit 3680-VN of WB.

SCOPE OF PROJECT - SOCIO-ECONOMIC PROFITS OF THE PROJECT The puRAPoses of Phuoc Long 220/110kV substation project are:

Concentrate and distribute the electricity capacity from Hydropower plants such as Thac Mo, Can Don and Srok Phumieng to the Southern main economic area in order to exploit effectually the output capacity of electrical sources.

Resisting overcharged for the existing 110kV transmission line and also the constructing power network of the area.

-

Enhancing the capacity of providing electricity and increasing the reliability and safety in power supplying for 110kV power network that can satisfy the increasing demand of additional charge of Binh Phuoc province and surrounding areas in period 2006-20 10.

Decreasing capacity and electrical energy loss of the 110kV power network of the area and increasing the electrical quality.

IMPACTS OF THE PROJECT There will be a total of 5 affected households. These households will be only impacted on agricultural land cultivating perennial trees, includes: Permanent acquisition land : total of the permanent acquired land for the substation is 24,220 m2 and tower foundation is 743 m2 -

Temporary impacts: the damage of trees, crops around construction areas of tower foundation and substation or the temporary roads for construction activities. Total of affected land in ROW of the connecting line is 5,297 m2

ELIGIBILITY The cut-off day is proposed to be set on January 3 lt, 2004. Project affected households (PAHs) are all households, institutions or organizations owning, renting or using land (with or without legal paper) that are affected by this project. All above households have right to be compensated for lost properties when they are in the inventory list or they can prove that they owned, rented, or used these properties before the cut-off day. Households having incomes affected by this project are applied similarly. PECC3

Households encroach into the project affected area after the cut-off day will not be compensated.

6.

RESETTLEMENT PRINCIPLES The capital resource of this project is from the remaining budget of SEIER project, credit No.3680VN of WB. The policies applied in RAP of the SEIER project were approved by Viet Nam Government and cleared by WB. So, the resettlement principles applied in this project followed the principles in RAP of the SEIER project and obeyed Vietnamese laws and World Bank policy on involuntary resettlement (OP 4.12). 1. Resettlement and compensation programs must be designed so as to allow the improvement or at least the maintenance of living standards of PAPs as before the project. 2. Both resettlement and land acquisition must be minimized as much as possible. 3. Resettlement distance must be minimized in case compensation is land-for land type. 4. Cash compensation for houses or structures shall be paid at the substitution cost; cash compensation for crops shall be paid at the market-price. 5. Resettlement period must be minimized and the cash of compensation should be provided to PAPs before the beginning of the construction activities affecting them, no site clearing if the full compensation have not been done yet. 6. All of PAPs who have houses and/or parcels located in the project area before the cut-off date are entitled receiving compensation according to their lost properties and/or incomes.

7.

ENTITLEMENT POLICY The resettlement principles applied in this project followed the principles in RAP of the main project and obeyed Vietnamese laws and World Bank policy on involuntary resettlement (OP 4.12). The policies were approved by Viet Nam Government and cleared by WB. Affected land area less than 25% total area and other losses are compensated in cash at the costs that were submitted by RCC to local PPC for approval. Affected land area more than 25% total area is compensated by the same quality and area or cash according to PAPs' option. The compensation costs for this project will be based on the compensation costs that were submitted by the RCC to the PPC for approval. Compensation is at approved costs for land, houses and perennial trees and at market prices for annual crops. The cost estimated for this RAP is based on the official price frames of Provincial People's Committees according to: -

The Decree No. 20/2003/QD-UB dated March, 18th 2003 of Binh Phuoc Provincial People's Committees on "Promulgation of compensation policy for land and compensation costs for houses, crops, structures in Binh Phuoc province"

-

Regulations of Decree No.87-CP of GOV and Circular No.145 of Ministry of Finance.

All the compensation unit costs will be re-checked at the beginning of RAP implementation by the Resettlement and Compensation committees (RCC) and, if necessary, they will be adjusted to meet the costs that were submitted by the RCC to the PPC foe approval and be approved by the Chairman of Local People Committee based on the proposal of the Local Finance and Price Department. Besides of compensation for damage, the affected households also will be received allowances and subsidies according to regulation of Decree 197. The allowances and subsidies are noted in Compensation Policy of the province.

8.

PUBLIC PARTICIPATION AND CONSULTATION This RAP is developed in close consultation with local authorities of Binh Phuoc province and PAP~s in order to maximize their participation in Resettlement Action Planning and implementing and the socio-economic benefits of PAPs to the project. The consultation with PAPs in disseminating PECC3

information and getting their feedback will reduce contradiction and avoid delays in project implementation. Local authorities and PAPs were consulted on line alignments, resettlement policy, RAP implementation, grievance mechanism, and monitoring and evaluation on the restoration of PAPs' livelihoods after the project implementation

9.

COMPLAINTS AND GRIEVANCES During the project implementation, PAP's complaints will be dealt with according to the Complain and Denounce Law of Vietnam and will be treated and guided fairly by related agencies. No addition fee will be paid for their complaints. The complaints mechanism is instructed in chapter VIII of this RAP.

10. INSTITUTIONAL ARRANGEMENT EVN and SPPMB are responsible for all of operations of the project including RAP implementation. SPPMB will be helped and closely cooperated by People's Committees of Binh Phuoc province and local relevant institutions.

11. IMPLEMENTATION SCHEDULE -

-

Establish compensation committees, select an independent monitoring agency, calculate compensation unit costs, consult from community would be carried out within one month as from the beginning of project's implementation. Compensation will be conducted after 3 months as from Provincial People's Committees has approved compensation cost and implementation schedule.

-

Receiving, dealing with complaints and grievances as from Provincial People's Committees approved compensation cost until project completion.

-

Monitoring will be carried out during project implementation.

12. COST ESTIMATING Total compensation costs are estimated about 806,175,000 VND, estimated cost for RAP implementation is about 183,808,750 VND. Total estimated cost for the resettlement program is about 1,143,431,231 VND.

13. MONITORING AND EVALUATION The implementation of RAP shall be constantly supervised and monitored by SPPMB. Moreover, an independent consulting agency will be entrusted with independent monitoring tasks. The independent monitoring agency selected by SPPMB will sign a contract just after RAP approval and will begin supervision and monitoring activities from the beginning of the RAP implementation phase.

CHAPTER I INTRODUCTION 1.1.

PROJECT DESCRIPTION Total area of the Phuoc Long 220kV substation is 24,220 m2 including the area of substation and access road. The substation locates on the Group No4, Thanh Tuan hamlet, Thanh Luong commune, Binh Long district, Binh Phuoc province. Substation size: - Model:

110kV connecting route: connect from the Ham Thuan - Phuoc Long 110Kv transmission line, Thac Mo - Tay Ninh 110kV double circuit transmission line and Srokphummieng - Loc Ninh 11 OkV transmission line to the Phuoc Long 220kV substation. 1.3.

IMPACTS OF THE PROJECT Main impacts of the Phuoc Long 220 kV substation include: - Permanent land acquisition at substation site, access road - Temporary impacts in construction phase due to material transport According to results of socio-economic survey, the project does not intersect any ethnic minorities or historical and cultural monuments. Basing on the investigation of Power Investigation and Construction Division (PECC3), the total of 2 2 the permanent acquired land area is 24,963 m (for substation is 24,220 m , pole foundations of 2 connecting route is 743 mi ), temporary acquired land area for connecting route is 5,297 M2 . The acquired land is perennial tree cultivated land. The project takes no impact on houses, residential land and other kinds of land.

CHAPTER II MITIGATION MEASURES 2.1.

MEASURES DURING THE DESIGN STAGE Many efforts are carried out to minimize the adverse impacts at the FS as well as the design stage, such as: In this phase, in order to minimize the project's impacts, the substation position is selected to meet the below requirements: -

Locations of the subprojects (substation, access road, line direction) is as near as possible to the existing national grid to minimize length of connecting tap, so, minimize land acquisition and losses;

Location of the project is nearby transportation roads;

-

The site chosen for the substation must agrees with the overall socio-economic planning program of the local, concurrently minimize the impacts on the environment.

-

Selection based on consultations with, agreement of local authorities, local people.

There are 3 alternatives for the substation location, and the alternative No.2 is selected because this alternative only impacts on agricultural land, without impact on houses of inhabitants.

2.2.

MEASURES DURING THE CONSTRUCTION STAGE In the construction stage, the construction organizing method and schedule will be used and optimized to comply with the current regulation of construction works and to minimize the negative impacts:

The temporary roads serving for construction are considered carefully (should go through vacant areas) in order to minimize the impacts and compensation.

Camps for workers in the construction period will be located on the favourable area, nearby headquarter of communes.

RESULTS OF EFFORTS The impacts of the project are shown as follows: - Permanent acquired land area that must be compensated is 24,963 m2 and the temporary acquired land is 5,297 m2 . 100% of this land is agriculture land which is cultivating perennial trees and other fruit trees. - Among 5 PAHs, there are 3 PAHs will be acquired more than 25% of its area. -

No impact on pagodas, temples, places of historical interest, natural reserved areas,

No impact on the community ethnic minorities.

CHAPTER III RESETTLEMENT POLICY AND ENTITLEMENT 3.1.

LEGAL FRAMEWORK The capital source of this project is from the remaining budget of the SEIER project, credit CR3680VN of WB financial resources. The resettlement policies applied in this project follow current Vietnamese laws on "Compensation and Resettlement" and the guideline of World Bank on involuntary resettlement (OP4.12). 3.1.1. Related laws, decrees and regulations 1. The Land Law of Vietnam dated July 1 4th, 1993. Amendment dated November 2 6 th, 2003. 2. The Government Decree N° 197/2004/ND-CP dated December 3rd, 2004 on compensation for the damage when the State recover land for national defense, security, national interests and public interests; 3. The Government Decree No.181/2004/ND-CP dated October 2 9 th, 2004 on the instruction for The Land Law 2003. 4. The Government Decree No.188/2004/ND-CP dated November 16 th, 2004 on the method the determining of the land price and frame price for types of land. 5. The CircularNo. 114/2004/TT-BTC dated November 2 6th, 2004 of the Ministry of Finance, on the instruction for Decree No.188/2004/ND-CP of the Government on the method the determining of the land price and frame price for types of land. 6. Tlhe CircularNo.116/2004/TT-BTC dated November 26th, 2004 of the Ministry of Finance, on the instruction for Decree No.197/2004/ND-CP dated December 3 h, 2004 of the Government on compensation, support and resettlement when the State recover land. 7. Circular 07/2001/TT-BCN of Department of Industry dated September 01st, 2001 on implementation guiding for some technical item stipulated in Government Decree No.54/1999/ND-CP dated July 08th, 1999 on safety protection of high voltage electrical network. 10. Circular No 106/2002/TTLT/BTC-BCN dated Nov 22nd, 2002 of Ministry of Industry on the compensation and subsidy costs for high voltage power network project. l1. The Decree No. 20/2003/QD-UB dated March, 18th 2003 of Binh Phuoc Provincial People's Committees on "Promulgation of compensation policy for land and compensation costs for houses, crops, structures in Binh Phuoc province" In order to carry out RAP according to OP 4.12 of the World Bank, some law provisions and decrees/circulars of Vietnam that not ensure the compensation according to the approved price or stipulating the provisions that not apply the compensation right and life recovery for the households who have not got valid documents in owning land will be dispensed from the applying by the Vietnam Government based on the approval of RAP policies of the SEIER project, credit 3680-VN. 3.1.2. OP 4.12 guideline of the World Bank According to the Guidelines of World Bank in Involuntary Resettlement Policy, project affected persons (PAPs) will be ensured improving or maintaining the living standards as before having the project. In order to agree with OP 4.12 of the World Bank, all of PAPs that are listed will be PECC3

project. In order to agree with OP 4.12 of the World Bank, all of PAPs that are listed will be compensated for lost properties. Only persons who settle at the site affected by the project after the statistical cut-off date are not compensated. Too, in order to agree with OP 4.12 of the World Bank, houses, structures, trees will be compensated according to substitution cost and farm produces, short-day crops will be compensated according to market costs. 3.1.3. Essential elimination In order to implement RAP according to OP 4.12 of the World Bank, some provisions of the law or regulation of Vietnam that not ensure the compensation according to the approved price or stipulate the provisions that not apply the compensation right for the affected households that not have valid documents in owning land will be dispensed from the applying. The provisions will be eliminated including: (i) Damage compensated right - Decree 197/CP Article 6 of Decree 197/CP (people that not be compensated for the loss of land) stipulate "People that is recovered land that not having one of conditions stipulated at Article 8 of this decree or offend against the plan that have been approved and promulgated at land using time or offend against security corridor of work; people that occupied land illegally will not be compensated for the lost land. In case of needing support, the province people's committee will considered at each specific case. Article 17 of Decree 197/CP (The principle of compensation for lost property), section 2, stipulate "Owner of the property that locate in illegal land as stipulated at Article 7 of this decree will be considered to support at each specific case by province people's committee". In order to ensure meeting the fundamental principles of RAP, the waivers of applying Article 7 and Article 17 of Decree 197/CP (to allow the households having illegal land as above to be compensated) were approved by Vietnam Government and cleared by WB for RAP of the SEIER project, credit 3680-VN. (ii) The land price for calculating compensation According to the regulation of the Vietnamese Government, the compensation price is calculated based on Decree 87/CP, 197/CP, 17/1998/ND-CP and Decision 20/2003/QD-UB of Binh Phuoc Provincial Poeple's Committee and the actual prices of lands in the local. The unit price for land compensation will be submitted to PPC for approval base on the proposal of the local Finance and Price Department or the RCC, and be ensured to equalize to substitution cost. (iii) Compensation principle - Decree 197/CP Article 19 of Decree 197/CP stipulates the compensation solutions for house, structure in different legal situations. In order to ensure meeting the fundamental principles of RAP, waivers of applying Article 19 and Article 20 of Decree 197/CP (in order to allow the households having affected house and structure to be compensated) were approved by Vietnam Government and cleared by WB for RAP of the SEIER project, credit 3680-VN. (iv) Support policy for the people hiring house that is owned by the Government - Decree 197/CP Article 21 of Decree 197/CP and Article 7 of Decision 4755/QD-UB-QLDT stipulate "PAPs are using the houses that be owned by the Government and located in the recovered scope if do not want to continue hiring Government's houses will be entitled to compensation at a rate equal 60% of the cost of the rented house and 60% of the cost of land". The waivers were approved by Viet Nam Government and cleared by World Band (for RAP of the SEIER project, credit CR3680-VN). The related PPCs will issue the official letter for their agreement in implementing the policies set forth in RAP. PECC3

DEFINITION AND LIMITATION OF ELIGIBILITY The cut-off day is proposed to be set on January

Project Affected Person (PAP) are all individuals, firms or institution with or without land registration papers who owned, rented or used land, properties and business which are affected by the project: All PAPs will be enztitled to full compensationfor their respective losses as long as they are included in the PAP intvenztory list or can prove that they used the affected itenms before the cut-off day. The samle applies to PAPs whose incomes are affected by the project. The cut-off date of this RAP has been fixed at the day of the inventory, DMS completion and will be proclaimed by local authorities. Encroachers who settled into the proposed affected areas after the cut-off date will have no entitlement to compensation and resettlement. They will be required to demolish their structures and cut the trees or harvest the crops for land clearance to the project. In case necessary, they will be forced to remove out the proposed project area. Nevertheless, they do not have to pay any fine or sanction.

3.3.

RESETTLMENT AND COMPENSATION PRINCIPLES These principles obey the Vietnamese laws and World Bank policy on involuntary resettlement. Vietnamese legislation and World Bank directives have been adapted to fit the specific condition of the project as define below:

3.4.

Resettlement and compensation programs must be designed so as to allow the improvement or at least the maintenance PAP's living standards as before executing the project.

-

Both resettlement and land acquisition must be minimized as much as possible.

-

Resettlement distance must be minimized in case compensation is land-for land type.

-

Cash compensation for houses/or structures shall be paid at the substitution cost; cash compensation for farm produce shall be paid at the market-price.

-

Resettlement period must be minimized and the cash of compensation should be provided to PAPs before the beginning of the construction activities affecting them, no land clearance if the full compensation has not been done yet.

-

All of PAPs having houses and land located in the project area before the cut-off date are entitled receiving compensation for their lost properties and/or income.

-

Resettlement and compensation plan should be carried out with consultation of PAP and approval by local authorities.

-

Resettlement and compensation plan must provide adequate institutional arrangement to warrant effectively and timely the proper implementation and monitoring.

-

Financial and technical resources for the resettlement and compensation should be available whenever required.

-

The living standards and income in the new sites should be maintained or improved more than before having the project.

-

The regulations in this RAP will be enforceable as an official legal document after be approved by the Government of Vietnam.

THE VALIDITY OF RIGHT CLAIMING COMPENSATION Legal PAPs are all of the affected households and organizations in the list (with or without legal paper of using land) or they can prove owning, hiring or using land and properties relating to land before the cut-off date of statistic. PECC3

In addition, legal PAPs are the households and organizations that having affected profession and/or business and income by the project due to temporary or endless recovery of land or different properties too.

3.5.

COMPENSATION POLICY -

-

Compensation for losses of farm products will be provided at the market prices. Compensation for houses, structures, trees, and other assets will be provided at the costs that were approved by the PPC. Compensation for land losses less than 25% of total land PAP holding will be paid at the appvoved cost for lost land area and all other losses in cash. Compensation for land losses equal or more than 25% of total land PAP holding will be provided in terms of land at the equivalent area and quality or in cash depending on PAP's choice.

3.6.

Compensation price will be defined according to tariffs established by the provinces and based on the Decree 87-CP and the Circular 145 of the Ministry of Finance. Due to the time from preparation to project execution can extend so the estimated price could unsuitable to market price or approved price at the time executing project. Therefore all of prices will be checked again and adjusted if necessary when beginning RAP implementation. Detail survey report will be carried out as soon as begin the project execution by resettlement committee. Independent monitoring agency, Province Finance Department will assess price list at the executing time. Compensation for crop will be paid in cash at the market rates and be calculated on productivity average of the last 3 years (on Circular 145 of Ministry of Finance). Compensation for land, houses and trees will be paid in cash at the approved price.

IMPACT CATEGORIES AND ENTITLEMENT POLICY By the nature of the project as described above and based on the surveys on the PAPs, the impacted categories could be classified as below: 3.6.1. Temporary impact: All of households have land, crops, trees or structures locating in ROW of the connecting route or in the temporary service roads. Category 1: The households have trees, crops, which are damaged temporarily by the project during the construction period due to material transport or pulling electric wire.

3.6.2. Permanent Impact:

The households have land and properties that will be recovered permanently for the tower foundations, the substation area, and the permanent roads for construction and maintenance of the project. All of households have houses (totally or partially of house area) or structure, or trees located in corridor of transmission line, which need to be removed, demolished, or cut. Category 2: The households have -house or structure which are partially dismantled and the dismantled portion will not affect to the safety of the entire house or structure and will be rebuilt in adjacent areas of the same owner. Impact on clearing away for residential areas will be temporary and it can be reused for restricted puRAPoses. Category 4: The households have house or structure which are partially or totally dismantled, (and the dismantled portion more than 25% house area or lower than 25% but unsafe for house structure), but does not have spare residential land for reconstructing house. Category 5: The households have agricultural land which will be acquired permanently by the project including the construction of tower foundations, substation and permanent roads for manager and maintenance of the project. SUBSIDY ALLOWANCES Besides the direct compensation for the losses, PAPs also entitled to subsidies/allowances as stipulated in the Decree No.197 of GOV. These allowances are as below: 3.7.1. Subsidy for house moving (transport allowance) (Article 27, Decree No.197) This allowance is for PAPs who are totally impacted on houses and have to be move to new sites or reorganize to the remaining residential areas. PAHs which have to move their houses to new places will be entitled to an allowance of 3,000,000VND. 3.7.2. Relocation Subsidy for Resettlement (Article 28, Decree No.197) This subsidy allowance is a food allowance for PAPs who are totally impacted on house and therefore have to reconstruct for their new houses. Each member of PAH will be subsidized 30kg of rice (equivalent) /person/month in six months. 3.7.3. Timely Movement Incentive (Article 26, Decree No.22) PAHs, who relocate on timely manner, will get a bonus of 3,000,OO0VND/household (maximum 5,000,000 VND/ household) 3.7.4. Rehabilitation Allowance (Article 29, Decree No.197) For PAHs which are permanent affected from 50% to 70% of productive land or incomes, 2 labour will be entitled to the allowance for each PAH; PAHs are more than 70% of productive land or incomes, all people in labour age will be entitled to the allowance of 1,000,OOOVND/person. CHAPTER IV PROJECT IMPACT 4.1.

SOCIO-ECONOMIC SURVEYS Socio-economic survey was carried out by PECC3 in April, May 2004. This section aims at providing basic data about socio - economic characteristics of the project area. These data are based on surveying of PAHs having land in ROW and the substation area. The survey information is on income sources, income, socio-economic situation; impact of resettlement on living standard and income. A lot of information was obtained. Some households could not point out the concrete income source and their revenue. However with 100% of PAPs included in the survey, socio-economic survey on PAPs also aims at identifying characteristics of affected area, assessing the development of population, houses, socio-economic, average income, health care, education, etc... 4.1.1 Population The substation locates on relative flat area, mainly is agriculture land used to cultivate perennial trees such as cashew, pepper and other fruit trees. This area having scattered resident with mean population density is 184 persons/km 2 . The characteristics of affected households: -

The average number of persons per household is 5.4, a bit higher than that of the whole country (4.97). Among which, the biggest household has 8 persons.

-

Young people (from 0 to 17 years old) present 33.3%.

-

The productive age group and old people accounts for 66.7%.

4.1.2. Income Sources of income: the main source of incomes of PAHs is from agriculture activities. Almost PAPs live by agriculture, a little is handicraft and wage-earner. The average monthly income of PAHs is 3,600,000 VND/month, among which PAH has highest income is 5,000,000 VND/month and the lowest is 2,400,000 VND. The living standard of PAHs is in average level, 100% PAHs are connected to the power network, having motorbikes and televisions. 4.1.3. Education Almost PAPs have secondary education level (make up 80% of the total PAPs), 20% of PAPs have primary education level, no PAP has high-school or university level of education. 4.2.

RESULTS OF CENSUS AND SOCIO-ECONOMIC SURVEYS The survey results are shown as follows: There will be a total of 5 affected households (27 persons), all affected households will be impacted on agricultural land. There are no households will be affected on houses or other structures. Among 5 PAHs, there are 3 PAHs will be acquired more than 25% of its area. However, these PAHs choose to be compensated for the affected land in cash. There is no impact on natural preserving zones, vestiges, pagodas, sensitive areas and ethnic minorities. Total affected land area by the project is 24,963 m2 permanent acquired land and needs to be compensated, this area is for constructing foundation of the substation. The temporary acquired land for ROW is 5,297 m2 in area.

CHAPTER V INSTITUTIONAL ARRANGEMENT 5.1.

ELECTRICITY OF VIETNAM (EVN) AND SOUTHERN POWER PROJECT MANAGEMENT BOARD (SPPMB) EVN is the project's investor, grants authority to SPPMB to plan and carry out all aspects of project, including RAP implementation. For direct works on the ground, SPPMB will be helped and closely coordinated by People's Committees of Binh Phuoc province and local relevant institutions. Department of Technology, Science, Environment and Telecommunication, belongs to EVN, is in charge of guiding and supervising the implementation of RAP for the project.

5.2.

POWER ENGINEERING & CONSULTANT COMPANY NO.3 (PECC3) PECC3 was assigned to carry out the census, inventory survey and prepare RAP cooperating with SPPMB to organize the public consultation for the project.

At the beginning of the RAP's implementation, Finance and Price Department co-operates with Construction Department, DONRE, Agricultural and Rural Development Department, People's Committee of districts and the independent supervising organization in order to evaluate the applied unit prices in RAP and offer to Provincial People's Committees for the adjustment if it is necessary to make sure that the compensation unit costs are at the approved price at the time of the compensation payment.

PROVINCIAL COMPENSATION COMMITTEES The provincial compensation committees are mainly responsible for: -

Helping district compensation committees in preparing the detail plan of compensation and resettlement.

Checking all inventories of impacts of the project and the detailed implementation plans of compensation and resettlement submitted by District Compensation Committees.

DISTRICT PEOPLE'S COMMITTEES District People's Committees are responsible for guiding the compensation and activities of resettlement of districts, including:

Organizing the survey team to carry out the detail measurement survey (DMS) for affected houses and properties; finalizing DMS and entitlement form for each PAP.

Checking compensation unit prices used in RAP, proposing to adjust the unit prices in conformation with market prices/approved costs (if it is necessary).

Cooperating with SPPMB, organizing meetings with PAPs, local authorities and popularizing entitlement forms to PAPs.

Basing on policies and approved processes of RAP, preparing detailed implementation plans (quarterly, semi annual, annual plans) and together with SPPMB paying the compensation money to PAPs in a timely manner.

Settling complaints and grievances of PAPs, resolving any difficulties during the project implementation, and pointing out solutions for the outstanding issues to Provincial Compensation Committees and Developers.

ESTABLISHMENT OF RESETTLEMENT COMMITTEES As soon as the project is approved, Compensation Committee will be established by the People's Committees of provinces and districts.

6.2

SELECT THE INDEPENDENT MONITORING AGENCY AND REVIEW UNIT COSTS APPLIED IN RAP At the early time of RAP implementation, SPPMB will select the qualified institutions for this task. The independent monitoring agency will review the RAP implementation and the unit costs applied in RAP, recommend for modifying if it is necessary

COMPENSATIONS AND ALLOWANCES CALCULATION At the beginning of the RAP implementation, Finance and Price Department co-operates with Construction Department, DONRE, Agricultural and Rural Development Department, People's Committee of districts and the independent supervising organization in order to evaluate the applied unit prices in RAP.

SUBMIT TO PROVINCIAL PEOPLE'S COMMITTEES COMPENSATION SCHEDULE AND COSTS' APPROVAL

FOR

The schedule as well as compensation unit costs, allowances and their adjustment (if it is necessary to make sure that the compensation unit costs are at the approved prices at the time of the compensation payment) will be submitted to Provincial People's Committees for the approval by the Provincial RCC. DETAILED MEASUREMENT SURVEY (DMS) SPPMB and Resettlement Committees will carry out DMS and finalize for their entitlements. The final result of DMS and entitlements will be disseminated to PAPs by communal authorities. SPPMB and RCs will also clearly inform PAPs on the adjustment for compensation unit costs.

6.6

PUBLIC ANNOUNCEMENT Just after the project approval, PAPs will be fully informed about the project, their rights and the specific policies of this RAP including eligibility provisions, entitlement policies, types and rates of compensation and allowance, adjusted compensation costs (if any), results of DMS, schedules, complaint and grievance rights and mechanism. Such information will be also delivered to the PAPs by SPPMB via meetings and documents leaved at Commune People's Committees or other places that are informed to each PAPs. Resettlement pamphlets will also be disseminated to each PAPs.

DEADLINES OF COMPENSATION AND RESETTLEMENT -

The compensation money for one-part damaged houses will be paid at least three months before starting the constructive execution.

The house repairing allowance will be paid together with the compensation money for the onepart damaged house.

The moving allowance will be paid at least six months but in just one time.

-

The compensation money for affected land areas and crops will be paid at least one month before starting constructive execution.

Affected land tenure households will be clearly cleaned up the required area at least one month before starting constructive execution.

The affected part of resettlement-households will be removed at least one month before starting constructive execution. In case of not complying, proper organizations will have rights to remove and the allowance for removing will be withdrawn.

MONITORING This task will be done by SPPMB and the independent monitoring agency through out the whole period of the RAP implementation

6.9

SCHEDULE One of provisions of this RAP is that RAP should be done in accordance with proposed basic principles. All RAP activities must be satisfactorily completed before World Bank gives a no objection for award of contract for the projects. Any changes to the RAP after WB clearance will require review by the WB Office in Hanoi before commencement of construction. This means that construction works must be logically followed and not preceded the execution of RAP program. In other words, in case of retards in RAP execution, the delay will be reflected in construction works. The proposed schedule for RAP implementation is shown in table 6.1

CHAPTER VII COSTS AND BUDGET 7.1.

COMPENSATION COSTS The compensation costs for houses, land and trees/crops are calculated based on the Decree No. 20/2003/QD-UB of Binh Phuoc Province and reality land prices in the local. These costs will be reviewed and adjusted by RCC and approved by Binh Phuoc PC at the beginning of RAP implementation to ensure that PAPs will be compensated at the approved costs for land, houses, trees, crops according to this RAP policy. 7.1.1 Compensation for Land According to Article 8 of Decree 197/CP stipulates that the compensation costs of revoked land shall be determined on the basis of local land prices that is issued according to the revisions of the Government multiplied by a coefficient "K" in order to guarantee the compatibility of compensation with the profitability and the price of transfer land use right in the locality. 7.1.2. Compensation for Houses According to article 18 of Decree 197/CP stipulates that house will be compensated from 1% to 100% of the new house value. In this RAP, compensation for house is calculated at 100% value of the new one. 7.1.3. Compensation for Annual Crops According to article 24 of Decree 197/CP guides that compensation for annual crops are calculated based on the average yields of the latest 3 years multiply with the market price at the calculation time. 7.1.4. Compensation for Trees and Fruit-Trees According to article 24 of Decree 197/CP guides that trees will be compensated at the real price at the time of land acquisition (fruit-tree will be compensated by the real price in the time of revoking land, trees will be compensated for the remaining harvests). 7.1.5. Compensation for other Properties Properties such as electric meters, telephone reinstall, graves, wells, tombs, etc... will be compensated at the approved costs In order to comply the project's resettlement policies, at the time of RAP implementation, the relevant departments under the PPCs and the Independent Monitoring Agency will carry out the survey on the approved costs for land, houses, trees and market prices for crops in the local area. Adjusting the compensation unit costs will be done by PPCs (if necessary) to ensure that the compensation costs for land, houses, trees are at the approved costs and the compensation costs for crops are at the market prices The cost estimate for RAP is shown in Table 7.1:

CHAPTER IX COMPLAINTS AND GRIEVANCES Since the entire resettlement and rehabilitation program is being carried out with the participation of the PAHs, it is expected that no grievance issue will be raised. However, to ensure that the PAHs have avenues for redressing their grievances related to any aspect of compensation and resettlement, detailed procedures of redresses of grievances have been established for the project. The objective is to respond to the complaints of the PAHs speedily and in a transparent manner. The mechanism is designed to be easy, transparent and fair. PAH's complaints and grievances will be dealt with according to customary procedures and according to Vietnamese law. PAH's complaints will be treated fairly and must be facilitated with assistance as they plead their cases. In addition, no fee shall be levied on them and in case legal supports are necessary, this shall be given to them free of charge. 9.1. PROCEDURE OF COMPLAINTS AND GRIEVANCES The sequence of complaints and grievances including: 1) Step 1: If there is any aspect of the resettlement and rehabilitation program from a PAP, it will be sent to Commune People's Committee. Commune People's Committee will transfer their contents to SPPMB and cooperate with SPPMB to resolve it through direct negotiation within 15 days from the day received complaints and grievances. 2) Step 2: If PAP is not satisfied with the decision in step 1, the complaints shall be brought and solved at related District authorities with the cooperation of SPPMB within 15 days from the date of the receipt of the decision in step 1. 3) Step 3: If the step 2 also fails, complaints will be transferred to provincial authorities. Fifteen-day period is limit time of resolving. 4) Finally, if the PAP is still dissatisfied with the decision, he/she can appeal to the Provincial/District People's Court (DPC) in accordance with the "Civil Procedure Act" within 15 days of receiving the decision of the SPPMB without being charged. DPC decision will be a legal basis for compensation. 9.2. LEGAL GUARANTEES FOR COMPLAINTS AND GRIEVANCES In order to make sure that SPPMB consider PAH's complaints and a fair settlement of litigation cases, negotiations will be observed by PAH's witnesses. Further, PAHs have rights to ask the helping of their selected representatives

CHAPTER X MONITORING AND EVALUATION RAP shall be constantly supervised and monitored by SPPMB in cooperation with local People's Committees. The WB OP 4.12 on Involuntary Resettlement recommends that independent activities are carried out. An independent monitoring agency will be entrusted with external monitoring tasks. The interested institutions have to submit their technical and financial proposals to SPPMB for review and then to WB for its concurrence. The chosen external monitoring institution shall be contracted by the SPPMB immediately after RAP approval and shall begin supervision and monitoring activities from the beginning of the implementation phase. Terms of Reference for independent monitoring will be prepared by SPPMB and then submit to WB for its concurrence

10.1.

INTERNAL MONITORING Internal supervision and monitoring include: a.

Monitoring the investigation of population and social economy situation and inventorying the PAP's damages, status, occupation and living condition and supervising the compensation, resettlement and rehabilitation of PAP in the term agreed by the PAP.

b. Monitoring whether the implementation of resettlement and compensation tasks are cared out as provided in this RAP.

10.2.

c.

Monitoring the availability and quality of replacement land.

d.

Monitoring the timely and sufficient deployment of resettlement and compensation funds for this RAP.

e.

Investigate and fairly assess each case of complaint and grievance.

f.

Internal monitoring agencies will prepare a quarterly report detailing the progress of RAP implementation. Such a report should be made available to appropriate Government authorities, WB and external monitoring agencies.

EXTERNAL MONITORING Beside evaluation the quarterly reports produced by internal monitors and conduct the same thing of investigation assigned to internal monitoring, the external monitoring agency will be responsible for following activities: a. Review and evaluate the inventoried results and entitlements determination. Check unit costs of compensation applied in RAP, to see if they are still at the approved costs and market prices at the time of RAP implementation and recommend to SPPMB for adjusting if necessary. b. Evaluation of socio-economic impacts of this project on the PAPs. c. Supervision of the implementation of RAP to achieve the objectives of the RAP in particular "to improve or at least maintain the incomes and living conditions of the PAP after the resettlement". d. Putting forward the amendments for the implementation of RAP so as to achieve the objectives of this RAP. e. Offering suggestions on how improve RAP programs f.

Closely monitoring compensation activities and be prepared to give informed evaluation of complaints and grievances cases.

g. Write working reports to be submitted to SPPMB and WB. PECC3

Base on the Decision No.52/1999/QD-UB dated March 2 5 'h 1999 of the Provincial People's Committee on the promulgation of process for compensation alterations as the Government withdraw land according to the Decree No.22/1998/ND-CP - Base on the Decision No.35/2002/QD-UB dated July 26h 2002 of the Provincial People's Committee on the promulgation of average price unit for civil and industry project on Binh Phuoc Province - Base on the Decision No.37/2002/QD-UB dated July 26th 2002 of the Provincial People's Committee on the promulgation of Methods to define construction areas, floor areas, areas of used land, level of houses, residual for affected houses. - According to the Proposal of Department of Finance - Price at the Statement No.49/TCVG dated January 21 th, 2003 -

DECIDE Clause 1: Enclose with this Decision the Unit price of compensation for land and houses, structure and crops on province to base on: - Caculating proverty value as land transfer - Compensation for loss of land that serve for the nation benefit and national defence and security according to the Dcree to No.22/1998/ND-CP dated April 2 4th, 1998 of the Government Clause 2: Base on the activities of each project, Compensation Council depend on market price units for each the period of time are the cost of land tranfer, the cost of land invesment (including house, structures, trees) and the added polycies at current regulations to form compensation plan for each project. This compensation plans will be appraised by Department of Finance - Price, approved by Provincial People's Committee which demonstrate to implement the activities of compensation and clearance for the project. - For project's capital by the budget of district and town which follows the approved class of compensation at Decision No.662/QD-UB dated April 23 th 2002 of Provincial People's Committee, Compensation Council of District and Town to report People's Committee of District and Town approve the cost of compensation which follows agreed price unit by Provincial People's Committee. Department of Finance - Price will receive 01 copy to follow after aprroved cost of compensation. - For project implemented inventory, compensation by the separated price unit and policy will not apply this Decision - For projects which still have not the policy and the compensation plan and have not inventory status will apply this Decision Clause 3: This Decision will replace Decision No.13/1999/QD-UB dated January 2 9 th 1999 and Decision No3O/2001/QD-UB dated April 2 6th 2001 of Provicial People's Committee.
